APPROVING THE AMENDMENTS OF CERTAIN PROVISIONS OF MEMORANDUM CIRCULAR NO. 08, SERIES OF 2003 PROVIDING IMPLEMENTING GUIDELINES FOR THE EDSA ORGANIZED BUS ROUTE PROJECT OF THE METROPOLITAN MANILA DEVELOPMENT AUTHORITY
WHEREAS, MMDA Resolution No. 03-28, series of 2003 approving the EDSA Organized Bus Route (OBR) Project and its Implementing Guidelines are approved by the Metro Manila Council on September 17, 2003;
WHEREAS, the same resolution authorizes the MMDA Chairman to revise or modify the EDSA-OBR implementing guidelines as may be necessary in its implementation, subject to the review of the Council;
WHEREAS, the implementing guidelines of the EDSA-OBR was issued by virtue of Memorandum Circular No. 08, series of 2003;
WHEREAS, during the implementation of the EDSA-OBR, it was observed that most of the bus drivers neither display their queue/dispatch cards on the bus' windshield nor return these at designated exit areas;
WHEREAS, it has been noted that most of the queue cards when returned/surrendered at designated exit points are marked with discourteous remarks and obscene drawings;
WHEREAS, there is a need to amend items 4.0 and 5.0 of Memorandum Circular No. 08 series of 2003 to include the aforementioned acts/violations in order to enjoin compliance thereto.
NOW, THEREFORE, be it resolved as it is hereby resolved pursuant to Section 6 of RA 7924, that the Metro Manila Council (Council), in session duly assembled, after due deliberation, hereby approves the amendments provided in items 4.0 and 5.0 of Memorandum Circular No. 08, series of 2003 hereto attached as Annex A.
This Resolution shall take effect upon approval.

Prescribing Implementing Guidelines for the EDSA Organized Bus Route
Project of the MMDA
1.0 Rationale
The Implementing Guidelines for the EDSA Organized Bus Route (OBR) Project of the MMDA was issued by virtue of Memorandum Circular No. 08, series of 2003. The said guidelines provided in detail among other things the fines and penalties for violation of the rules prescribed therein.
During the implementation however, it was observed that most of the bus drivers neither display their queue/dispatch numbers nor return these at designated exit areas.
Moreover, it has been noted that most of the queue cards when returned/surrendered are marked with obscene drawings and discourteous remarks.
Furthermore, a thorough review of the said Memorandum Circular shows that Item 4.0 (Other Provisions) is silent about prohibition on the act of defacing/marking/drawing on the queue cards. Likewise, there is a need to rephrase Item 5.0 column 1 (Action) of the same Circular to provide a better and more detailed provision under the said Item. Hence, there is a need to clarify and amend item 4.0 by providing specific acts therefore and rephrasing some portions of Item 5.0
2.0 Objectives
1. To instill discipline and ensure compliance by the bus drivers as part of their regular duties to secure color-coded queue numbers at designated dispatch points, display these on the right side of the bus windshield and surrender the same at designated exit points.
2. To prevent bus drivers from making unnecessary marking/writing on the OBR queue card.
3.0 Amendment
3.1 Item No. 4.0 (Other Provisions) paragraph 4.5 of the said Memorandum Circular is hereby amended to read as follows:
3.2 Item No. 4.0 is hereby further amended by adding another provision thereto which shall be numbered as 4.6 and shall read as follows:
3.3 Nos. 5 and 6 and 7 of Item 5.0 (Fines and Penalties) of the said circular under the 1st column (Action) and the 3rd column (Penalty) respectively are hereby amended which shall now read as follows:
3.4 Item 5.0 is hereby amended by adding another provision thereto to be numbered as No. 10 which shall be read as follows:
4.0 Effectivity
This Memorandum Circular shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation in Metro Manila.

"4.5 All bus drivers plying the EDSA route are required to undergo a one-day seminar at the Traffic Operations Center, Metro Manila Development Authority. Bus Operators and Traffic Enforcers shall likewise undergo a separate one-day seminar or as may be necessary to be able to understand the details of the EDSA Organized Bus Route Project, for proper dissemination of information and training of the drivers."
3.2 Item No. 4.0 is hereby further amended by adding another provision thereto which shall be numbered as 4.6 and shall read as follows:
"4.6 Defacing/Marking and/or Writing any remark and obscene drawings and other similar acts that may cause deformity on the queue card is strictly prohibited."
3.3 Nos. 5 and 6 and 7 of Item 5.0 (Fines and Penalties) of the said circular under the 1st column (Action) and the 3rd column (Penalty) respectively are hereby amended which shall now read as follows:
