AMENDMENT TO SECTION 113 HORSES
Please be informed that the Philracom Board in its meeting held on June 8, 2001, after due deliberation resolved to amend Section 113 of the Horseracing Rules and Regulations which will now read as follows:

SECTION 113. PENALTIES FOR RACE HORSESThis rule shall take effect fifteen days after publication.
113.1 VICIOUS HORSES - A horse is considered "vicious" if it acts or behaves as described in Sections 113.11, 113.12, and 113.13.
113.11 Does not leave the starting gate (refused to run) within two (2) seconds or more, therefore, compromising or diminishing its chance of success.
Said horses will be required to pass the barrier trials and time requirement for vicious horses two (2) consecutive times in order to be eligible to participate in a regular race *.
All succeeding repetitions of viciousness (bad start) shall follow the same pattern of two (2) consecutive good starts.
There will be no penalty for any late starter if the horse wins the race.
113.12 Comes out of the starting gate but uncontrollably swerves (veers in or out), refuses to stop running, turns around and/or behaves in any way that is analogous to the foregoing, as determined by the Board of Stewards.
PENALTIES:
1st Offense - unmanageable - warning 2nd Offense - vicious - 15 calendar days 3rd Offense - vicious - 30 calendar days Subsequent Offenses - vicious - 60 calendar days
No penalty if the horse wins the race, as long as it did not hit, impede, obstruct and/or interfere with any other runners. If the horse loses. then the penalty above will be imposed.
Any horse penalized for above offense will be required to pass the barrier trial and time requirement for vicious horses in order to be eligible to participate in a regular race *.
113.13 If a horse is savage and poses danger to the lives and limbs of grooms, starting gate helpers, jockeys, and other persons in the racetrack, then said horse will be prohibited from participating in races until it is found fit and a clearance is issued by the Philracom. ISCDEA
113.14 Vicious horses may be allowed to run in the barrier trials twice every raceweek.
113.2 HORSES COMING IN 75 METERS (OR MORE) BEHIND THE THIRD PLACER will be suspended for a period of one (1) month.
113.21 Penalty will be waived for horses in the Maiden Division or those coming from vacation, as long as its performance is equal or better than the barrier time.
113.22 Penalty will also be waived if the horse from the Maiden Division has not yet won in the Winners Division, as long as its time is equal or better than its previous performance. The waiving of penalty can only be done twice.
113.3 HORSE WHO SUFFERED FROM EPISTAXIS (NOSE BLEEDING) DURING THE RACE.
PENALTIES: 1st Occurence - warning 2nd Occurence - 30 calendar days 3rd Occurence - 60 calendar days Subsequent Occurences - 60 calendar days
Penalty is waived if the horse wins the race but will be required to pass the barrier trial and time requirement.
Any horse penalized from epistaxis will be required to pass the barrier trial and time requirement before it can be eligible to participate in a regular race *.
* A regular race will mean any race where betting is allowed.
