[ MMDA RESOLUTION NO. 03-06, s. 2003, February 21, 2003 ]
CONFIRMING THE DECISION OF THE MMDA CHAIRMAN TO LIFT THE EXEMPTION OF BUSES FROM THE UNIFIED VEHICULAR VOLUME REDUCTION PROGRAM SPECIFIED IN THE MEMORANDUM OF AGREEMENT ENTERED INTO BY AND BETWEEN MMDA, IMBOA, PBOAP AND SOLOBOA
WHEREAS, with the enactment of the said regulation, a Memorandum of Agreement was made by and between MMDA, IMBOA, PBOAP and SOLOBOA in July 1996 exempting the buses of said bus operators associations from the UVVRP Scheme;
WHEREAS, the MOA entered into authorizes the MMDA to recall the exemption in the event of rampant violation of traffic rules and regulations committed by bus drivers or in case of accidents due to recklessness by bus drivers or negligence in the maintenance of bus units;
WHEREAS, on February 03, 2003, the Council passed MMDA Resolution No. 03-03, series of 2003 suspending the implementation of the UVVRP Scheme in order to determine if it is already appropriate to lift the same;
WHEREAS, in a span of one week suspension of the UVVRP Scheme, there was heavy traffic flow along major thoroughfares;
WHEREAS, one of the identified causes of heavy traffic flow is the bulk of Public Utility Vehicles (PUVs) including buses plying along the major thoroughfares of Metro Manila;
WHEREAS, the MMDA Chairman decided to lift the exemption of said bus groups from the UVVRP Scheme in order to ensure safe and convenient movement of persons and goods in Metro Manila.
WHEREAS, the Metro Manila Council (Council) considers the aforesaid decision as a significant move in solving the traffic mess in Metro Manila.
NOW, THEREFORE, be it resolved as it is hereby resolved, pursuant to Section 6 of Republic Act 7924, that the Council hereby confirms the decision of the MMDA Chairman to lift the exemption of buses from the UVVRP Scheme as specified in the MOA entered into by and between MMDA, IMBOA, PBOAP and SOLOBOA.
RESOLVED FINALLY, that the Council hereby authorizes the MMDA Chairman to decide whether to lift or not the UVVRP as the situation warrants.
This Resolution shall take effect upon approval
