[ NTC MEMORANDUM CIRCULAR NO. 11-10-97, October 20, 1997 ]
GENERAL BIDDING PROCEDURE FOR THE ASSIGNMENT OF RADIO FREQUENCIES
Pursuant to RA 7925 and its Implementing Rules and Regulations, the Commission hereby promulgates the following:
Radio Frequency Bands for Existing and Duly Authorized PTEs
1. Applications for the assignment of radio frequencies shall be filed with the Commission within forty five (45) days after the publication of the radio frequencies available for assignment to specific services. Applicants must have prior authorizations from the Commission for the specific services for which the radio frequencies shall be used.
2. If there are more applicants for specific radio frequency/ies, the Commission shall conduct bidding within ninety (90) days from the date of publication of the assignable radio frequencies.
3. The minimum bid price shall be equivalent to the SUF for the specific service.
4. Should there be available radio frequencies after 45 days from date of publication and assignment, applicants who have prior authorizations from the Commission shall be processed on a first come first served basis.
Radio Frequency Bands for PTEs for De-regulated Services
5. Applications for the use of the radio frequencies shall be submitted to the Commission not later than 60 days from the date of publication in a newspaper of general circulation of the allocated radio frequency bands.
6. If the number of qualified applicants, i.e. with valid franchise and duly incorporated, exceeds the allocated radio frequencies, bidding shall be conducted not later than 150 days from the date of publication of the allocated radio frequencies.
7. The minimum bid price shall be equivalent to the SUF for the specific service.
Radio Frequency Bands for New Applicants for Regulated Services
8. Applications for the use of the radio frequencies shall conform with the bidding procedures for PMTS, Section C-I of this circular except in so far as Section C-I (1) where the Commission shall specify the period of acceptance of applications.
9. This Circular supersedes, amends or modifies existing circulars, orders and guidelines that are inconsistent herewith.
10. This circular may be revised, revoked or amended as necessary in accordance with law and shall take effect fifteen (15) days after publication in a newspaper of general circulation and three (3) certified copies furnished the UP Law Center.
