[ MMDA RESOLUTION NO. 07-19, June 21, 2007 ]
REQUIRING CONCERNED DRIVERS AND REGISTERED OWNERS OF VEHICLES TO JOINTLY AND SEVERALLY PAY THE UNIT/SUPPLY AND RESTORATION COST OF A DAMAGED TRAFFIC FACILITY AND/OR ROAD AMENITY
WHEREAS, the Metro Manila Development Authority (MMDA) has been doing its best to ease the flow of traffic, ensure public safety and provide convenience to motorists and pedestrians in Metro Manila by ensuring that the roads/roadways are properly maintained and equipped with necessary traffic facilities/road furniture/amenities, among others;
WHEREAS, the supply/unit and restoration cost of these traffic facilities/road furniture/amenities entail expenditures from the government;
WHEREAS, it has been noted that a number of damaged traffic facilities and road amenities are due to the irresponsibility of some motorists who carelessly drive their cars unmindful of the result of their actions which to some extent have partially if not totally damaged these without paying any amount for the replacement and restoration of the same;
WHEREAS, there is a need to require the concerned driver and the registered owner of the vehicle to jointly and severally pay the supply/unit and restoration cost of any traffic facility and/or road amenity that the former has damaged to replace the expenses incurred by the government relative thereto.
NOW, THEREFORE, be it resolved as it is hereby resolved, pursuant to Section 6 of RA 7924, that:
SECTION 1. Coverage. Any motorist including the registered owner of the vehicle shall jointly and severally pay the unit and restoration cost of a traffic facility and/or road amenity that the driver has damaged.
SECTION 2. Supply/Unit and Restoration Cost. The cost of any damaged traffic facility/road amenity shall be determined by the Traffic Engineering Center of the MMDA with the approval of the General Manager and the Chairman.
SECTION 3. Implementing Guidelines. The MMDA Chairman shall issue the necessary Implementing Guidelines to this effect and may amend the same as the need arises without requiring the approval of the Metro Manila Council.
SECTION 4. Effectivity - This Resolution takes effect fifteen (15) days upon publication in two (2) newspapers of general circulation.
