[ ERB RESOLUTION NO. 90-12 DATED SEPTEMBER 21, 1990, September 21, 1990 ]
MAXIMUM RETAIL PROCES OF PETROLEUM PRODUCTS AND ALLOWABLE WHOLESALE POSTED PRICES
On September 21, 1990, applicants Petron Corporation, Caltex (Phils.), Inc. and Pilipinas Shell Petroleum Corporation in ERB Cases Nos. 90-384, 90-106 and 90-382, respectively, were provisionally authorized by this Board to increase the prices of the various petroleum products refined and/or marketed by them locally by the weighted average of P1.42 per liter. In another case, ERB Case No. 90-353, the Board also granted on September 21, 1990, the Philippine Federation of Petroleum Haulers' Association a provisional increase in the hauling rate by P0.28 per kiloliter of petroleum products per kilometer for the first 25 kilometers, the rate going down gradually after the first 25 kilometers such that the longer the distance traveled, the lower would be the hauling rate. On the same day, the Petron Dealers' Association, Inc. (PETDA), Philippine Petroleum Dealers Association, Inc. (PPDA), Caltex Dealers Association of the Philippines, Inc. and Shell Dealers Association of the Philippines, Inc. were authorized provisionally to increase their mark-up on gasoline, diesel and kerosene by 3.3 centavos (P0.033) per liter, in ERB Cases No. 90-400, 90-389 and 90-383, respectively.
Further, the Board provisionally authorized the Liquefied Petroleum Gas Institute of the Philippines (LPGIP) in ERB Case No. 90-385 to increase their margin by P0.04 per liter, effective at 6:00 P.M. on September 21, 1990. On the other hand, the applicants in ERB Case No. 90-360 were provisionally authorized to increase the existing hauling rate of LPG by P0.0007842 per kilogram per kilometer also effective September 21, 1990 at 6:00 P.M.
Based on the certification issued by the Department of Public Works and Highways regarding the distance between Poro and the sites/areas located inside the Philex Mining site which movants-applicants Juan Zarate, Jr., et al. in ERB Case No. 87-10 submitted in compliance with the Board's directive, the prices for gasoline, diesel and kerosene in the aforesaid sites/areas are fixed by this Board in the price list (Annex "A-1"), attached to this resolution.
Actual costs of transshipping the products from the refinery to the different terminals/depots are reflected in the wholesale posted prices (Annex "A") nationwide.
IN VIEW OF THE FOREGOING, this Board hereby directs and requires all petroleum entities concerned, particularly, (a) the gasoline station operators/dealers, to sell their petroleum products at prices not exceeding the maximum retail/pump prices indicated in the list (Annex "A-1") attached to and made an integral part of this resolution and, (b) the oil companies, to market their products at prices not exceeding the allowable wholesale posted prices indicated in Annex "A" hereof.
Said parties are further advised to take note and observe the following:
A. All items for posted price differential (PPD) previously authorized as payback for investment incurred in establishing new and necessary depot facilities in strategic areas, and those for company transshipment differential (CTD) designed to ensure the continuous operation of some depots by the oil companies, shall accrue to the latter. The items for rounding-off differential (RD) shall accrue in the meantime to the oil companies. In this connection, the oil companies are hereby directed to submit to the Board, within twenty (20) days the following month, a monthly report, by depot, on the PPDs, CTDs and RDs above-mentioned.
B. Wharfage fee, if any, shall be borne solely by the oil companies, and shall not be charged to resellers or dealers.
C. The haulers by sea shall charge the same water hauling rate of P0.077 per liter authorized in favor of overland haulers in the metro areas.
D. The retail prices for kerosene, indicated in the price list (Annex "A-1") shall consists of "(a)" - pump prices, "(b)" - ambulant resellers, and "(c)" - retailing by sari-sari stores.
The retail price for kerosene to be charged by ambulant resellers - "(b)" and retailing by sari-sari stores - "(c)" is the retail/pump price for kerosene of gasoline station dealers to the consumers in their respective areas, plus handling charges.
Ambulant resellers - "(b)" handling charges in Metro Manila Area and in areas outside Metro Manila Area are P0.10 and P0.15 per liter, respectively.
The handling charges of sari-sari stores "(c)" in Metro Manila area and in areas outside Metro Manila Area are P0.25 and P0.30 per liter, respectively.
E. All operators/dealers of filling, curb pump and service stations whose pump prices of petroleum products have as yet not been set shall, jointly with their respective oil company-suppliers, submit to this Board within thirty (30) days from September 21, 1990 their price build up which shall be supported by such data and information, among other things, as the manner in which they procure their fuel, their source depots and the authorized invoiced arrastre, trucking and barging of freight costs.
F. The dealers and resellers of petroleum products are required to submit to this Board quarterly reports on their monthly sales volume, by product, within the first twenty (20) days of the month following the three-month reporting period.
The increase in the prices of the LPG as of September 21, 1990 in the different areas throughout the country is indicated in Annex "B'" which is made an integral part thereof.
In connection with the foregoing, all LPG marketers and refillers all over the country are hereby directed to submit to the Board within thirty (30) days from receipt hereof their LPG price list, inside and outside base, for 11 kgs., 22 kgs. and 50 kgs. cylinders of LPG for the different channels of distribution nationwide, incorporating the increase in dealers' mark-up as approved in ERB Case No. 90-385, application of LPGIP for increase in LPG dealers' margin.
Finally, the prices herein indicated, and the prices set forth in the attached lists, shall take effect on September 21, 1990 at 6:00 P.M..
In the meantime, in view of the recent earthquake that rendered some of the main roads in Northern Luzon impassable to vehicular traffic, the oil companies are hereby directed to furnish the Board within fifteen (15) days from receipt hereof with reports of the areas where their outlets were either isolated or had to traverse other routes in order to withdraw petroleum products from their designated source depots, including the alternative but most accessible source depot wherein said affected outlets can withdraw petroleum products, including the distance in kilometers of the same from said affected outlets.
Let copies of this Resolution be furnished the oil companies, the Presidents of the different oil companies' dealers associations, the President of the Philippine Federation of Petroleum Haulers' Association, the President of the Liquefied Petroleum Gas Institute of the Philippines (LPGIP) as well as the Presidents of Individual Haulers' Associations of the Philippines, Inc., who are directed to disseminate the contents hereof within their respective areas of operation.
