[ MMDA RESOLUTION NO. 07-11, March 22, 2007 ]
REQUIRING ALL CABLE NETWORK, POWER AND ALL OTHER UTILITY COMPANIES TO SECURE PERMITS FROM THE METROPOLITAN MANILA DEVELOPMENT AUTHORITY FOR PROJECT EXPANSION OR INSTALLATION OF NEW WIRES AND CABLES ON POSTS ALONG MAJOR ROADS WITHIN METRO MANILA
WHEREAS, whenever telecommunications, cables, power and other utility companies do expansion, repair or maintenance works along major thoroughfares, vehicular traffic flow is impeded and traffic congestion is aggravated in these areas;
WHEREAS, it has been observed that the skyline of Metro Manila had deteriorated with the presence of unkempt and unsightly poles, wires and cables attached on several poles;
WHEREAS, there have been incidents, especially during inclement weathers that poles are toppled and had posed not only inconvenience but put the lives, limbs and properties of the public at risk;
WHEREAS, it has, likewise, been observed that the quality of wires and cable installation works undertaken by some personnel of these companies have undermined the effort of the government to uplift the physical and aesthetic sense of Metro Manila s environment;
WHEREAS, RA 7924 mandates MMDA to formulate, coordinate and monitor policies, standards, programs and projects involving the physical development of Metro Manila and the safety of its inhabitants;
WHEREAS, the Metro Manila Council, in session duly assembled, after due deliberation, recognized the need to immediately address the physical deterioration and safety of the public by regulating acts inimical to the sustainable development and improvement of Metro Manila.
NOW, THEREFORE, be it resolved, as it hereby resolved, pursuant to Section 6 of RA 7924, that the Council hereby requires all cable networks, telecommunication, power and all other utility companies to secure first a permit from the Metropolitan Manila Development Authority before any installation of any aerial wires or cable related with their expansion or rehabilitation programs.
RESOLVED FINALLY, that the Chairman of the Metropolitan Manila Development Authority shall issue the necessary guidelines, rules and procedures relative to the issuance of such permits including the coverage, imposition of fees, fines and penalties to violators.
This Resolution takes effect upon approval.
