GUIDELINES IN THE APPREHENSION OF UNREGISTERED MOTOR VEHICLES



In view of the implementation of the "No Plates - No Run" Policy of the government, the following guidelines in the apprehension of unregistered motor vehicles should be observed:

1. Pursuant to Section 2 of Administrative Order No. 83 AO-DIR-001 on the rules and regulations governing the issuance and use of motor vehicle conduction stickers, the conduction sticker attached to a motor vehicle shall be valid until the same is sold and delivered to the end-user;

2. Pursuant to Section 5 of Administrative Order No. 3 on the rules and regulations on new system of registration pursuant to Batas Pambansa Blg. 43 and 74 amending related provisions of RA 4136, otherwise known as the Land Transportation Traffic Code, delivery of motor vehicles from the assembly line to the dealers thereof, or to the PNP-TMG for clearance, or those from one place to another for such period not to exceed seven (7) days, shall be done through a conduction permit. Upon expiration of the said seven (7) days, if the motor vehicle is still unregistered, the motor vehicle should not be operated on public roads;

3. The conduction permit which shall have the validity of seven (7) days shall be used only for registration purposes and during the said period the motor vehicle shall be covered by an insurance and shall be accompanied with a delivery receipt and sales invoice;

4. Those motor vehicles without plates will be flagged down and shall be impounded if there are no proofs of registration presented;

5. Those motor vehicles with no plates shall not be subject to the automatic impound rule if they are for registration and with valid conduction permits;

6. Those who failed to obtain or attach the validating stickers, if apprehended are required to show the Certificate of Registration (CR) and Official Receipt (OR) , which shall be considered substantial evidence that the motor vehicle is registered; and

7. Pursuant to Section 15 of RA 4136, on the use and authority of the motor vehicle's Certificate of Registration (CR) and Official Receipt (OR) for the current year, the said certificate and OR or in lieu thereof a true copy or photostat thereof shall be preserved and carried in the motor vehicle by the owner as evidence of the unit's valid registration.
