[ PPA MEMORANDUM CIRCULAR NO. 32-96, August 19, 1996 ]
CLARIFICATORY GUIDELINES ON THE TREATMENT OF AREAS UTILIZED FOR STORAGE AND PARKING OF CARGO HANDLING EQUIPMENT AND GEAR
Further to pertinent provisions of AO No. 22-95, otherwise known as the Real Estate Management Regulation, specifically sections 4, 5, 6, and 10, and in order to provide uniform treatment of port real estate utilized for parking, stacking or storing of cargo handling equipment and gears, the following clarifications are hereby issued:
I
Coverage
This Circular shall cover all PPA ports and their respective duly authorized arrastre and stevedoring operators.

Clarifications
2.1 All areas in the port which are officially designated as parking spaces for cargo handling equipment and stacking or storage areas for cargo handling gears, shall be treated as part of the operational areas and, therefore, not subject to rental fees.
2.2 Motor pools and office spaces shall be provided to cargo handling operators but the same shall be subject to rental charges in accordance with the rental provisions of AO 22-95.
2.3 The size of areas to be designated for parking and storage of equipment and gears shall depend on the nature and number of units actually utilized by the contractor in its cargo handling operations. This shall be determined by the Port Manager.
2.4 Designation of the above-mentioned areas shall be included in the port lay-out plan in accordance with Section 6 of AO 22-95.

Repealing Clause
All PPA orders, circulars and issuances which are inconsistent herewith are hereby repealed or modified accordingly.

Effectivity
This Circular shall take effect immediately.
