SUPPLEMENTARY GUIDELINES TO PPA AO NO. 03-92 IN LINE WITH NEW MARINA FUNCTIONS TRANSFERRED FROM PCG

Purpose
This Order shall apply to all vessels engaged in domestic trade calling at government or private ports in the country.
Purpose
To prescribe guidelines on the approval of vessel clearance due to the transfer of certain functions from the Philippine Coast Guard (PCG) to the Maritime industry Authority (MARINA)
Guidelines
4.1 In accordance with the 22 November 94 Memorandum of Agreement (MOA) between the Philippine Coast Guard and the Maritime Industry Authority, certain specific safety regulatory functions in the construction/operation of vessels shall now be performed by MARINA. As specifically provided in this MOA, MARINA's inspection will be for purpose of issuance or renewal of certificates, permits or licenses that vessels are required to carry, while PCG's inspection will be for purposes of verifying compliance to existing national and international laws, rules and regulations, and for law enforcement.
4.2 Consistent with the guidelines and documentation process prescribed in PPA Administrative Order No. 03-92 and PPA Memorandum Circular No. 15-93 which were issued to implement EO 493 (Simplification of Vessel Clearance Procedures), the withholding of the approval of vessel clearance by PDOs/PMOs, or their representatives, can be effected upon receipt of an official written Request/Notice from MARINA or PCG to hold a vessel for violating its respective rules and regulations.
4.3 PPA shall subsequently grant clearance to the vessel only after a written Lifting Order/Clearance has officially been issued by MARINA or PCG and received by PPA.
4.4 When PPA Clearance has already been issued ahead of the MARINA or PCG Notice to Hold the vessel, the latter shall give its Hold Order directly to the Master/Shipping Company, copy furnished PPA. Accordingly, the PMO shall endeavor to recall the clearance it has issued, if still possible.
4.5 On the local level, PPA shall coordinate and arrange with concerned parties/agencies that Hold Notices are issued within a reasonable period/cut-off time to prevent delays.
4.6 The Port Management Offices (PMOs) of PPA shall, likewise, coordinate with local MARINA and PCG officials/representatives to achieve effective documentation and reporting systems.
4.7 Upon proper coordination with or request from MARINA or PCG, PPA shall make available to said agencies copies of the Coasting and Passenger Manifests and other sources of data/reports on shipping traffic. Reproduction expenses shall be shouldered by these agencies.
Amendatory Clause
All PPA issuances, rules and regulations inconsistent herewith are deemed modified or amended accordingly.
Effectivity
This Order shall take effect fifteen (15) days after its publication in a newspaper of general circulation.
