SUPPLEMENTAL RULES AND REGULATIONS IN THE RELEASE OF CY 1995 INFRASTRUCTURE FUNDS

Purpose

This Supplemental Circular is being issued to:

1.1 prescribe guidelines in the incurrence of obligations relative to infrastructure projects, both locally-funded and foreign-assisted, including GATT-related projects funded under Republic Act No. 7845 (CY 1995 General Appropriations Act) and Executive Order No. 182 (Public Works Act), pending implementation of the Simplified Fund Release System (SFRS); and

1.2 provide additional guidelines in the issuance of Notice of Cash Allocation (NCA).

Guidelines on Incurrence of Obligation

2.1 Pending Implementation of the SFRS, all departments/agencies implementing both locally-funded and foreign-assisted infrastructure projects, including GATT-related projects, approved by the President are authorized to incur obligations for purposes of entering into contract and/or other preliminary activities. The amount shall not exceed the respective authorized appropriations for projects specifically listed in RA 7845 and programmed under EO 182 for CY 1995, net of reserve imposed pursuant to Section 5.4 of National Budget Circular No. 436, dated December 28, 1994.

2.2 Incurrence of obligations pertaining to lump-sum appropriation under the budget of departments/agencies implementing infrastructure projects will only be authorized upon submission and approval of the Special Budget (Detailed List of Projects).

Additional Guidelines on the Release of NCA

The DBM shall release separately the initial NCA to cover the first quarter estimated cash requirement for the implementation of infrastructure projects on the cash program required to be submitted under NBC 436.

4.0
Saving Clause

All other provisions of NBC No. 437 shall apply. Cases not covered by this Circular shall be referred to the concerned Budget and Finance Bureau of the Department of Budget and Management.

5.0
Effectivity

This circular shall take effect immediately.
