PERMIT/LICENSE TO OPERATE CUSTOMS BONDED WAREHOUSE
Notice is hereby given that beginning January 2003 Customs Bonded Warehouses with expired permit/authority to operate customs bonded warehouse of any type shall not be allowed to process their shipments.
In this connection, it shall be the responsibility of the Collector, Subport of FTI Customshouse, Chiefs, Operating Divisions of customs bonded warehouses concerned, Port of Manila and Chief of equivalent units in the outports, to give written notice to the CBW Operators one month prior to the expiration of the permit/authority to operate CBW. It shall also be the responsibility of the Customs Bonded Warehouse Committee to act on the renewals of the permits/licenses to operate a CBW within fifteen (15) days from receipt of clearances as required provided that all the documents required from CBW operators have been submitted.
The Office where clearance is sought shall certify whether or not the CBW seeking for renewal has any pending case, unliquidated entries/bonds, outstanding liability or any information as to merit denial of the application for renewal. The Offices where clearance is sought shall not require that folders of the warehouses applying for renewal to be presented to them before they issue the clearance. The clearing office shall rely on its own records in the issuance of clearance and are reminded of the pertinent provision of CMO 39-91. It shall be the responsibility of the Warehousing Documentation and Records Division or Chief of the equivalent units in the outports to submit the clearance(s) on or before ten (10) days from receipt of the application(s) for renewal.
This Memorandum shall be strictly enforced under pain of administrative sanction(s) as warranted.
