AMENDMENT TO SECTION 37, ARTICLE IX OF RESOLUTION NO. 02-04, OF THE BOARD OF MARINE DECK OFFICERS AND RESOLUTION NO. 02-03, OF THE BOARD OF MARINE ENGINEER OFFICERS (RE: REVISED RULES AND REGULATIONS IMPLEMENTING REPUBLIC ACT NO. 8544, THE PHILIPPINE MERCHANT MARINE OFFICERS ACT OF 1998 )
WHEREAS, the records of the Maritime Office of the Commission have shown a number of cases involving tampering of an item/data/entry on a Certificate, an official document, thereby destroying the integrity thereof.
WHEREAS, the said tampering of an item/data/entry on a Certificate perpetrated by a Marine Officer is without authority and constitutes an unethical, unprofessional and/ or dishonorable conduct.
WHEREAS, there is a need to emphasize and make more specific that the tampering of an item/data/entry on a Certificate is a ground for administrative disciplinary action against a Marine Officer.
WHEREFORE, the Boards RESOLVE, as it is hereby RESOLVED, to amend Section 37, Article IX of Board Resolution Nos. 02-04 and 02-03, the Revised Rules and Regulations Implementing Republic Act No. 8544, otherwise known as the Philippine Merchant Marine Officers Act of 1998 , of the Board of Marine Deck Officers and Board of Marine Engineer Officers, respectively, which shall now read as follows:
This Resolution shall take effect after fifteen (15) days following its full and complete publication in the Official Gazette or in a newspaper of nationwide circulation whichever is earlier.

Section 37. Grounds for Disciplinary Action - The grounds for proceeding against a registered/licensed Marine Deck Officer or an applicant/ examinee in the licensure examinations for marine deck officers shall include but shall not be limited to the following acts:
1. Use or perpetration of any fraud or deceit in obtaining a Certificate of
Registration, Competency or Endorsement
2. Immoral and/or Dishonorable Conduct
3. Unprofessional and/or Dishonorable Conduct
4. Incompetence
5. Negligence
6. Illegal practice
7. Fraudulent Application (section 15)
8. Tampering of an item/data/entry in the Certificate of Registration, STCW Certificate of Competency, STCW Endorsement Certificate or any appropriate Certificate/Certification issued by the Board or the Commission
9. Violation of the Rules and Regulations Implementing R.A. No. 8544
10. Violation of the Code of Ethics for Marine Deck Officers.
11. Violation of any provision of R.A. No. 8544 x x x
