CLARIFYING THE AUTHORITY AND EXTENT OF THE POWERS AND FUNCTIONS OF THE PRESIDENTIAL ANTI-CRIME COMMISSION



WHEREAS, pursuant to Executive Order No. 3 dated 7 July 1992, the Presidential Anti-Crime Commission (PACC) was established with the principal task of directing and coordinating the activities of various law enforcement agencies to effect a more vigorous campaign against criminality; and

WHEREAS, to prevent the overlapping of functions, streamline the operations, and identify the responsibilities of the various law enforcement agencies involved, it is necessary to clarify the authority and extent of the powers and functions of the PACC.

NOW, THEREFORE, I, FIDEL V. RAMOS President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby order:

SECTION 1. Pursuant to Executive Order No. 3, s. 1992, the PACC shall act primarily as a coordinating body with such powers and functions enumerated under said Executive Order. For this purpose, the PACC's technical and administrative staff shall be organized into a coordinating center or secretariat.

SECTION 2. The PACC may call upon existing units or offices of the Philippine National Police, National Bureau of Investigation, National Prosecution Service, and other law enforcement agencies enumerated in Section 5 of Executive Order No. 3, upon prior coordination with the head of agency concerned, to carry out the mandated functions of such agencies with respect to the crimes enumerated in Section 4 of said Executive Order. Pursuant to Executive Order No. 3, the PACC shall not conduct independent police operations or investigations.

SECTION 3. The PACC shall have general supervision over all task forces organized in accordance with Executive Order No. 3. Operational control over task forces composed entirely of representatives from an implementing law enforcement agency shall be retained by such agency. Operational control over a task force composed of representatives from a combination of any of the implementing law enforcement agencies mentioned in Section 5 of Executive Order No. 3 shall be exercised by the implementing law enforcement agency whose representative is designated to lead such task force.

SECTION 4. The PACC shall undertake research work and maintain a database of information relating to crimes, offenders, modus operandi, victims and other information that may be submitted or culled from the reports of the various law enforcement agencies enumerated in Section 5 of Executive Order No. 3 for the purpose of advancing the fight against criminality and the efforts at improving the administration justice.

SECTION 5. All policy decisions by the PACC, as a collegial body, shall be taken by a majority vote of all its members.

SECTION 6. This Executive Order shall take effect immediately.
