In compliance with Presidential Memorandum Circular No. 121, dated 02 October 1990, as implemented by Department Order No. 66-90 of the Department of Finance dated 29 November 1990, and as recommended, the following schedule of revised fees and charges of the Land Transportation Office (LTO) are hereby adopted for implementation:

III. FINES/PENALTIES FOR VIOLATIONS OF LAND TRANSPORTATION LAWS
A. VIOLATIONS IN CONNECTION WITH LICENSING:
1.	Driving without license		750.00
2.	Driving with delinquent, invalid, suspended, ineffectual, revoked or improper license		300.00
3.	Failure to show or surrender driver's license for cause upon due demand by person with authority to confiscate		150.00
	Failure to carry driver's license when operating MV		150.00

		- For the 2nd offense, 1 year suspension in addition to the fine

B. VIOLATIONS IN CONNECTION WITH REGISTRATION:
11.	Operating an MV which is unregistered/ improperly registered/delinquent or with invalid registration (Driver and Owner).		450.00 each
	If driver is also the owner, MV shall be impounded until properly registered.		900.00
12	Operating MV with unregistered substitute or replacement engine, engine block or chassis, change color, change body or configuration.         In addition, MV shall be properly impounded until such parts are properly registered.		500.00
13.	Failure to carry in the MV the Certificate of Registration (CR) and Official Receipt (OR) (original or photocopies)		150.00
14.	Operating/Allowing the operation of a MV with a suspended/revoked CR. MV shall be impounded or its plates held during period of suspension/revocation.		450.00

C. VIOLATIONS IN CONNECTION WITH NUMBER PLATES AND STICKERS

E. WEIGHTS, AND LOAD LIMITS
37.	Load extending beyond projected width without permit (imposed upon driver)		200.00
38.	Overloading; the driver shall be fined:
	a.	Operating MV w/wheel, axle, or axle group loads in excess of the limits in Sec. 9, RA 4136 or any regulation without permit.	150.00
	b.	Operating MV with total weight of cargo carrying device on passenger truck including cargo exceeds 100 kilos.	150.00
	c.	Allowing more passengers and/ or more freight or cargo in his vehicle more than the registered carrying capacity (If PUV, imposed upon conductor)	150.00
	d.	Baggage or freight carried on top of truck exceeds 20 kilos per sq. meter and not distributed in such a manner as not to endanger the passenger or stability of the truck.	150.00
F. PROHIBITED OR ILLEGAL OPERATION OF MOTOR VEHICLES
39.	OUT OF LINE Operation of MV for hire, the driver and owner/operator shall each pay a fine.		Dr. - 500.00   Opr. - 500.00
		DL shall be confiscated and suspended for 1 week.
		1st offense - confiscation and suspension for 1 week in addition to the fine;
		2nd offense - confiscation and suspension for 1 month in addition to the fine;
		3rd offense - 3 months suspension in addition to the fine;
		4th offense - revocation of DL in addition to the fine
40.	COLORUM OPERATION (driver) -
	a.	1st offense - fine of P500 and suspension of DL for 3 months	500.00
	b.	2nd offense - fine of P750 and suspension of DL for 6 months	750.00
	c.	3rd offense - fine of P1,000 and revocation of DL	1,000.00
41. COLORUM OPERATION (Owner/Operator)
	a.	Fine of P1000 and confiscation of plates for 3 months - 1st offense. If despite the suspension of CR, the MV is used even as private vehicle, the same shall be impounded pending suspension and subject to Sec. 15 hereof	1,000.00
	b.	A fine of P2,000 for the 2nd offense, the MV shall be impounded for 6 months	2,000.00
	c.	A fine of P3,000 for 3 rd offense and cancellation of franchise	3,000.00
G. BREACH OF THE CONDITION OF FRANCHISE AND RELATED VIOLATIONS
42.	Employing insolent, discourteous or arrogant drivers or conductors (imposed upon owner/operator)		400.00
43.	Refusal to convey passenger to proper destination/trip cutting (imposed upon owner/ driver)		1,000.00
44.	Refusal to render public service to public (imposed upon owner/operator)		1,000.00 each
	Confiscation of DL and suspension for 1 month
45.	Non issuance of fare ticket (imposed upon owner/operator and the conductor)		375.00 each
46.	Unauthorized commercial or business name/allowing another to use his commercial or business-name (imposed upon the operator/owned)		375.00
47.	Undue preference or unjust descrimination (imposed upon the owner/operator and the driver)		500.00
48.	Overcharging/Undercharging above or below authorized schedule of passenger rates, (imposed upon the driver or conductor)		500.00
	The owner/operator shall also be fined. For each subsequent offense the license of the driver or conductor shall be suspended for one (1) month.		500.00
49.	Breach of the franchise conditions, except when otherwise penalized under any provisions (imposed upon the owner/operator)		375.00

H. FRAUDS AND FALSITIES

		- within 5 m. of the intersection of curb lines
		- within 4 m. of the driveway entrance to any fire station
		- within 4 m. of a fire hydrant
		- in front of a private driveway

56.	Failure to dim headlights		150.00
57.	Driving in slippers or sleeveless shirt		100.00
58.	Imposed upon the driver of a motor vehicle a fine of:		100.00
		- driving in a place not for traffic or parking in a place not for parking
		- failure to give way to police or fire department vehicle or ambulance.
		- hitching or permitting a person on a bicycle or skate roller to hitch to the vehicle
J. VIOLATIONS INVOLVING TAXI UNITS
59.	Fast, tampered, defective or non-operational taxi meter/tampered, broken, fake or altered meter seal (imposed upon owner/operator)		2,500.00
		In addition to the fine,	1st - 2,000.00
		1st offense - confiscation of DL and suspension for	2nd - 3,000.00
		3 months;	3rd - 5,000.00
		2nd offense- confiscation and cancellation of DL and suspension for 6 months; and	1,000.00
		3rd offense - revocation of DL and franchise
60.	Tampered, broken, joined, reconnected, fake or altered sealing wire (imposed upon owner/operator)		1,000.00
		The license of the driver of said taxi shall be confiscated and suspended for:   1st offense - 1 month suspension in addition to the fine;   2nd offense - 3 months suspension in addition to the fine; and   3rd offense - 6 months suspension in addition to the fine.
61.	Refusal to render service to public or to convey passenger to his destination (impose upon owner/operator)		1,000.00
	The license of the driver shall be suspended for 1 mo
62.	Impose upon the owner/operator of a taxi unit a fine of:		375.00
	a.	Violation of color scheme, adoption of new color or design without authority
	b.	Unregistered/unauthorized tradename or businessname or unauthorized use thereof
	c.	No body number on both sides
	d.	Old meter, transmission or triplex seal.
	e.	Loose triplex seal
	f.	Flagged up meter/operating on contractual (imposed upon driver)	500.00
		The license of the driver of said unit shall be confiscated and suspended for 1 month.
63.	No taxi driver's uniform (imposed upon driver)		100.00
64.	No taximeter (imposed upon driver/owner/operator) and impounded of MV until meter is duly installed each		1,000.00
65.	Installing aircon unit without authority		750.00
	Failure to paint "aircon" on authorized unit - (imposed upon owner/operator)		750.00
66.	Failure to provide light on taximeter (imposed upon owner/ operator)		150.00
	Failure to provide top light indicating availability (imposed upon owner/operator) Failure to provide clean seat cover (imposed upon owner/ operator)		150.00
67.	Failure to put owner/operator's name and address on taxi unit (imposed upon owner/operator)		150.00
68.	Impose upon the driver of a motor vehicle a fine of P150.00 for any of the following violations:

The foregoing shall be without prejudice to the institution of appropriate criminal charges as the evidence and circumstance may warrant.

It is understood that all other existing fees and charges not herein listed shall remain at the same rates and shall continue to be enforced.

The revised rates herein prescribed shall be published once a week for two (2) consecutive weeks in two newspapers of general circulation in the Philippines and shall take effect fifteen (15) days thereafter.

All Department Memorandum Orders, Circulars and other Administrative Issuances in conflict with this Department Order are hereby deemed revoked, amended or revised accordingly.
