LETTER OF INSTRUCTION 04/99 (BOMBA)
1. References
a. Presidential Memorandum dated October 1, 1998 concerning reported unauthorized and illegal mining at Mt. Diwalwal in Monkayo Compostela Valley; and
b. Letter of Secretary Antonio H. Cerilles of DENR dated October 23, 1998.
2. Situation
The proliferation of the illegal use of explosives by unscrupulous entity/group/individual resulted to injury to unwitting victims and damages to the natural resources. More so, the bombing of US Embassies in Nairobi and Tanzania which caused the death for a number of people and the destruction of properties might also inspire terrorists groups in the country to do the same.
3. Purpose
This LOI sets forth the operational guidelines on the updating, inspection and related security measures pertaining to explosives and explosive ingredients to ensure that the explosives will be used for legal purposes and will not fall in the wrong hands.
4. Missions
The Philippine National Police, being the government agency tasked to monitor and regulate explosives and explosive ingredients, will conduct an accounting/inventory and inspection of all existing explosives/explosive ingredients together with their magazines and storage.
5. Concept of Operations
The PNP shall formulate a system to account and monitor all importation, manufacture, movements, storage, and disposition of all explosives/explosive ingredients existing in the country. To ensure the smooth implementation and effectiveness of regulating explosives and explosive ingredients, this shall be executed in three (3) phases, as follows:
Phase I. Updating of all manufacturers, importers, dealers, users and possessors of explosives and explosive ingredients.
Phase II. Conduct inspection of all existing magazines and storage. Inspecting units shall check the compliance of security measures in the storage and handling of the explosives and explosive ingredients.
Phase III. Report of compliance and sustain the control measures and the movement of explosives/explosive ingredients.
6. Tasks
a. Directorate for Operations - Supervise the smooth and strict implementation of this LOI.
b. Police Regional Offices 1-13, CAR and ARMM (except NCR)
1. Consolidate the report of all RDs on the accounting and inventory of all explosives and explosive ingredients;
2. Update the records of manufacturers, dealers, importers, users and possessors of explosives and explosive ingredients and all magazines existing in NCR.
3. Conduct an inspection of all existing magazines in CR;
4. Ensure that all movements of explosives in NCR will be properly escorted;
5. Ensure that the manufacturers, dealers, purchasers and users have a Permit to Purchase and Move Explosives/Explosive Ingredients; and
6. Perform other tasks as may be deemed necessary and appropriate.
d. Aviation Security Group
1. Ensure that all movements (loading) of explosives/explosive ingredients are ; properly accounted, secured, and escorted by uniformed PNP personnel; and
2. Perform other tasks as may be deemed necessary and appropriate.
e. Maritime Group
1. Ensure that all movements (loading) of explosives/explosive ingredients are properly accounted, secured, and escorted by uniformed PNP personnel; and
2. Perform other tasks as may be deemed necessary and appropriate.
f. Traffic Management Group
1. Ensure that all movements of explosives/explosive ingredients are loaded in close van; properly accounted, secured, and escorted by uniformed PNP personnel; and
2. Perform other tasks as may be deemed necessary and appropriate.
g. Intelligence Group
Provide the CSG timely intelligence on terrorist plans/activities to CSG.
7. Coordinating Instructions
a. Consumption reports of manufacturers, dealers, purchasers and users must be duly attested by the Provincial Directors.
b. Inspecting units shall ensure/undertake appropriate measures that all magazines are properly secured.
c. Movements of explosives and explosive ingredients must be properly escorted by PNP personnel. Detailed PNP escort personnel to be in proper uniform.
d. Lateral/vertical coordination with other government agencies concerned with explosives is authorized and encouraged.
e. Director, Civil Security Group to render periodic report to the Chief, PNP thru the Director for Operations.
f. A copy of the Explosives Law is attached for reference/enforcement/implementation.
8. Effectivity
This LOI takes effect upon approval.

3. Submit monthly report (every last week of the month) on the consumption of explosives and explosive ingredients in respective AOR;
4. Ensure that the movements of explosives will be properly secured.
5. Ensure that the manufacturers, dealers, purchasers and users have a Permit to Purchase and Move Explosives/Explosive Ingredients;
6. Ensure the compliance of the Police Provincial Directors, City/Municipal Chief of Police Station Commanders of the requirements of the Explosives Law especially on the accounting, importation , manufacturing, movement, storage and disposition of explosives and explosive ingredients within respective area of jurisdiction; and
7. Perform other tasks as may be deemed necessary and appropriate.
