[ DTI DEPARTMENT ADMINISTRATIVE ORDER NO. 10-10, December 15, 2010 ]
FURTHER AMENDING THE REVISED IMPLEMENTING RULES AND REGULATIONS OF ACT NO. 3883, AS AMENDED, OTHERWISE KNOWN AS THE BUSINESS NAME LAW, PRESCRIBING FOR NEW REGISTRATION FEES
WHEREAS, the Department of Trade and Industry (DTI) pursuant to Title X, Book IV of the Administrative Code of 1987 and to effectively implement the provisions of Act No. 3883, as amended, otherwise known as the Business Name Law has issued Department Administrative Orders Nos. 10-01, 10-03, and 10-08 all Series of 2010, Implementing the same Act;
WHEREAS, the aforesaid implementing rules have instituted a localized scheme for registration of business name that entails imposition of a four-tiered registration fee/ ladderized system based on geographic divisions. Said proposed adjusted fees were part of the topics presented in a series of public consultation;
WHEREAS, Memorandum Circular No. 137 dated 20 July 2007 issued by the Office of the President mandates prior approval by the National Economic and Development Authority (NEDA) Board of any increase or adjustment of government imposed fees;
WHEREAS, DTI has sought the approval of the NEDA Board of the proposed adjusted fees;
WHEREAS, a NEDA certification dated 10 December 2010 states that the NEDA Board through ad referendum approved the Proposal of the Department of Trade and Industry (DTI) for Modification of the Fee for Business Name Registration ;
THEREFORE, the following is hereby prescribed.
SECTION 1. Subsection 9.1 of Rule II of DAO No. 10-01 Series of 2010 as amended is further amended to read as follows:
SECTION 2. Repealing Clause - All orders, rules and regulations pertaining to the registration of BNs which are inconsistent herewith are hereby repealed or modified accordingly.
SECTION 3. Effectivity Clause - This Order shall take effect upon its publication in two (2) newspapers of general circulation. Three (3) copies of this Order shall be sent to the National Administrative Register at the University of the Philippines Law Center.

9.1 The Department shall collect THE FOLLOWING REGISTRATION FEES FOR EVERY APPLICATION FOR REGISTRATION OF BUSINESS NAME (ORIGINAL AND RENEWAL) DEPENDING ON THE TERRITORIAL JURISDICTION COVERED IN THE APPLICATION:
10.1.1. BARANGAY
- PHP 200.00 10.1.2 CITY/MUNICIPALITY - PHP 500.00 10.1.3 REGIONAL - PHP1,000.00 10.1.4 NATIONAL - PHP2,000.00
