[ LTO MEMORANDUM CIRCULAR NO. ACL-2009-1189, July 28, 2009 ]

IT PROVIDER SYSTEM ENHANCEMENT



To streamline the current validation process and eradicate the proliferation of œNon Appearance Testing  and œAppearance Without Testing  in Private Emission Testing Centers, IT Providers are hereby directed to immediately adopt extreme measures to finally eliminate the said anomalies.

In consonance with the ongoing review and evaluation of existing systems and procedures, IT Providers are hereby ordered to incorporate the following criteria and courses of action:

1. Enhancements must protect data integrity and with the capability of automated vehicle data and/or images translation and uploading without human intervention;

2. The process of emission test data capture, collection, transmission and validation must be seamless and must be restricted within a specified and timed procedure;

3. The system must allow for a back up procedure for purposes of validating the images captured;

4. Data uploaded must reflect realistic physical volume of traffic for each emission test lane;

5. The system should have the capacity to sense geographical limits. Only motor vehicles tested by a PETC within a specified geographical area will be allowed to be registered in a particular LTO District Office;

6. Further enhancements must be made for the system to allow the LTO to pin point the particular and actual PC being used by a PETC;

7. Such improvements must support all the necessary requirements of the Clean Air Act.

Non-compliance to this Circular shall be subject to the penalties prescribed under Section 10.1, Department Order No. 2005-37.

This Memorandum Circular covers all PETC nationwide and shall take effect fifteen (15) days upon publication with U. P. Law Center and/or in three (3) newspapers of general circulation.
