[ NTC MEMORANDUM ORDER NO. 07-07-2009, July 20, 2009 ]

RECALL/WITHDRAWAL OF MEMORANDUM CIRCULAR NO. 13-06-2000



WHEREAS, the 1987 Constitution fully recognizes the vital role of communications in nation building and provides for the emergence of communications structures suitable to the needs and aspirations of the nation;

WHEREAS, Republic Act 7925 mandates the Commission to promote consumers welfare by facilitating access to telecommunications services whose infrastructure and network must be geared towards the needs of individual and business users and to protect consumers against misuse of telecommunications entity ™s monopoly or quasi-monopolistic powers by but not limited to the investigation of complaints and exacting compliance with service standards from such entity;

WHEREAS, on June 16, 2000, the Commission issued Memorandum Circular No. 13-06-2000;

WHEREAS, due to the rapid development of telecommunications technology and prevailing environment, around 69 million subscribers as of end of 2008 as compared to 2 million subscribers in 2000, and numerous pricing regimes in place rendering the provisions of MC No. 13-06-2000 no longer applicable;

WHEREAS, a Technical Working Group (TWG), composed of NTC, telecom industry players and other stakeholders, is studying the issues and setting forth the necessary guidelines on the matters cover ed by MC No. 13-06-2000, based on t he prevailing telecom environment;

WHEREAS, the Commission has already issued Memorandum Circular No. 03-07-2009 and Memorandum Order No. 03-06-2009, respectively, addressing the concerns on the validity period of prepaid loads and the services performance standards for the cellular mobile telephone service;

NOW, THEREFORE, pursuant to Republic Act 7925, Executive Order 546 series of 1979, and in order to protect and promote the interest of the public, the Commission hereby orders the recall/withdrawal of Memorandum Circular No. 13-06-2000, to take effect immediately upon the publication of this Memorandum Order in a newspaper of general circulation and submission and filing of at least three (3) copies thereof with the University of the Philippines Law Center.
