[ MMDA MEMORANDUM CIRCULAR NO. 08, S. 2010, October 27, 2010 ]
AMENDMENT TO MEMORANDUM CIRCULAR NO. 04, SERIES OF 2010, ENTITLED REVISED GUIDELINES ON THE ISSUANCE OF EXEMPTIONS FROM THE UNIFIED VEHICULAR VOLUME REDUCTION PROGRAM (UVVRP) UNDER MMDA REGULATION NO. 96-005, AS AMENDED
Whereas, there is a growing need to implement programs and projects to ease the worsening traffic condition in major thoroughfares in Metropolitan Manila;
Whereas, the MMDA Chairman is authorized to issue the necessary implementing guidelines under Section 3 of MMDA Regulation No. 96-005;
Whereas, there is a need to limit the coverage of exemptions being granted under the above-mentioned regulation;
Whereas, the Metropolitan Manila Council, in its meeting on October 15, 2010, adopted Resolution No. 10-16, Series of 2010, wherein it was decided that public utility buses, both provincial and city, should be included in the coverage of the Unified Vehicular Volume Reduction Program (UVVRP) under MMDA Regulation No. 96-005, as amended;
NOW THEREFORE, in view of the foregoing, the following amendments to Memorandum Circular No. 04, Series of 2010, entitled Revised Guidelines on the Issuance of Exemptions from the Unified Vehicular Volume Reduction Program (UVVRP) under MMDA Regulation No. 96-005, as amended, are hereby adopted:

Whereas, the MMDA Chairman is authorized to issue the necessary implementing guidelines under Section 3 of MMDA Regulation No. 96-005;

NOW THEREFORE, in view of the foregoing, the following amendments to Memorandum Circular No. 04, Series of 2010, entitled Revised Guidelines on the Issuance of Exemptions from the Unified Vehicular Volume Reduction Program (UVVRP) under MMDA Regulation No. 96-005, as amended, are hereby adopted:
Section 1. Public Utility Provincial and City Buses shall be covered under the Unified Vehicular Volume Reduction Program (UVVRP) from 7:00 A.M. to 7:00 P.M. Section 3 of Memorandum Circular No. 04, Series of 2010 is hereby amended by deleting sub-section c) thereof, and shall thereafter read as follows:
Section 3. In addition to the foregoing, the following are also exempted from the UVVRP:
a) Motorcycles pursuant to MMDA Memorandum Circular No. 96-005B (1998).
b) DOT accredited tourism vehicles expressly marked as such.
c) Pursuant to MMDA Regulation No. 98-056-A, conduct passes shall be granted to the following on a limited basis:
- Heavy vehicles delivering petroleum products,
- Heavy vehicles undertaking international messengerial services,
- Heavy vehicles utilized as garbage trucks,
- Emergency vehicles of power and water companies,
- Heavy vehicles being utilized by the government in the construction of flagship projects as identified by the MMDA and subject to the issuance of a valid certification and trip pass by the government authority concerned such as the DPWH, DOTC, LGUs, PEA, at al.
- Heavy vehicles carrying perishable goods in commercial quantity.
Section 2. Section 5 of Memorandum Circular No. 04, Series of 2010, is hereby amended to read as follows:
Section 5. Pursuant to this Memorandum Circular, except for vehicles mentioned under Section 2 (a), (b), (c), (d), (e), (f), (i), (j) and Section 3 (a), the MMDA shall issue exemption certificates and conduct passes in accordance with MMDA Regulation No. 96-005, as amended, MMDA Regulation 98-006- A, and MMDA Regulation 10-001.
All UVVRP exemptions and truck ban conduct passes granted under this section shall not include authority to use the Epifanio Delos Santos Avenue (EDSA).
Section 3. All previous memorandum circulars inconsistent with the foregoing are hereby modified, amended, or repealed accordingly.
Section 4. This Circular shall take effect on November 15, 2010.
