CLARIFICATION ON COVERAGE AND APPLICATION OF VARIOUS EMISSION TESTS CERTIFICATES
In connection with the full implementation of Memorandum Order dated 2 September 2002 directing that no motor vehicle shall be registered without proof of compliance to emission standard pursuant to the mandate of Section 1 Rule XXXIV of RA 8749 (Clean Air Act) and its Implementing Rules and Regulations (IRR) effective 1 October 2002 per the undersigned's Memorandum dated 30 September 2002, hereunder are the various emission test certificates/documents required for different kinds of registration:
1. Certificate of Emission Compliance (CEC) - this is required for RENEWAL of annual registration and retrieval of confiscated license plates of vehicles apprehended for smoke belching.
1.1 This CEC which will be issued by the Private Emission Testing Centers (PETCs) accredited by the DTI and authorized by the DOTC for renewal of annual registration shall be valid within sixty (60) days from date of testing and issuance thereof (Rule XXXIV, Sec. 1, IRR). The CEC shall be required only for renewal of registration and does not cover miscellaneous registration transactions involving change of ownership, change of chassis/engine or the like. The requirement for a CEC covers motorcycles/tricycles.
1.2 The testing and the CEC required for the retrieval of the vehicle or license plates in connection with smoke belching apprehension may be conducted and issued by either the LTO testing center or the PETC (Rule XXXV, Sec. 4 IRR).
2. Certificate of Compliance to Emission Standard (CCES) - this is required for the INITIAL/FIRST registration of second-had CBU imported motor vehicles and for rebuilt motor vehicles. The CCES is issued by the DOW (Rule XXXII, Sec. 2 IRR).
3. Certificate of Conformity (COC) - This is required for the INITIAL/FIRST registration of brand-new motor vehicles (locally manufactured or assembled (CKD) and imported CBU) including motorcycles. This is issued by the DENR/Environmental Management Bureau (EMB). (Rule XXXI, IRR) Notice shall be given all concerned as soon as the DENR/EMB implements the issuance of the COC:
All district chiefs are hereby reminded and directed to strictly implement the 2 September 2002 Memorandum Order in a manner that is most convenient to LTO's clients under the circumstances.
All Orders/Memoranda inconsistent herewith are deemed superseded.
