AMENDING FISHERIES GENERAL MEMORANDUM ORDER NO. 001 SERIES OF 2011 ON THE PRE AND POST BORDER REQUIREMENTS IN THE APPLICATION OF SPS CLEARANCE FOR IMPORTATION OF FISH/FISHERY PRODUCTS FROM JAPAN

In view of the developments in the nuclear crisis in Japan wherein the radionuclide levels in fish and fishery products have not exceeded Japan s provisional regulation limits except in the prefectures of Fukushima, Ibaraki and Gunma, Fisheries General Memorandum Order No. 001, series of 2011, is hereby amended as follows:
1. All applications for SPS Clearance for the importation of fish and fishery products from the prefectures of Fukushima, Ibaraki, Tochigi and Gunma, shall be accompanied by radionuclide test results for Iodine 131, Cesium 134 and Cesium 137 from the competent authority of Japan, showing that the fish and fishery products conform with the guidance levels for representative radionuclides in food under Philippine Nuclear Research Institute (PNRI) Administrative Order No. 01, series of 2009;
2. All applications for SPS Clearance for the importation of fish and fishery products from other prefectures shall be accompanied with a Certificate of Origin from the competent authority of Japan, indicating the prefecture of origin of the consignment;
3. The importtation of cherry salmon, sand lance, Japanese dace and ayu from Fukushima is not allowed;
4. In case consignments of fish and fishery products from Japan are detected to contain radionuclide beyond threshold levels at PNRI s radiation portals at the port of entry, the consignments shall be confiscated and sent to PNRI for analysis. The PNRI has the authority to decide on the proper disposition of confiscated consignments.
5. All expenses related to the laboratory analysis, storage, transport and disposal of confiscated contaminated consignments shall be borne by the importer.
This Memorandum Order shall take effect immediately and shall remain in force unless earlier revoked.
