[ CUSTOMS MEMORANDUM ORDER NO. 17-2005, March 31, 2005 ]
MORATORIUM ON APPROVALS TO ESTABLISH/OPERATE OFF DOCK CY-CFS, CUSTOMS PUBLIC/PRIVATE BONDED WAREHOUSES, COMMON BONDED WAREHOUSES AND OTHER NON-MANUFACTURING BONDED WAREHOUSES/FACILITIES
SECTION 1. There shall be a moratorium on the processing and approval of applications to operate and establish the following:
1. Off Dock CY-CFS
2. Customs Public & Private Bonded Warehouses
3. Industry Specific Bonded Warehouses
4. Common Bonded Warehouses
5. Other Non-Manufacturing Bonded Warehouses/Facilities
SECTION 2. Applications for the operation and establishment of the aforesaid facilities shall be denied outright until further instructions from the undersigned.
SECTION 3. An application for the re-activation of inactive facility whose operation falls within the above CBW classifications shall be treated under Section 2 of this Order and thus, shall be instantly denied.
SECTION 4. The moratorium shall not cover however, applications for the establishment and operation of Customs Bonded Manufacturing Warehouses pursuant to Section 2001 to 2004 of the Tariff and Customs Code of the Philippines as amended, as well as applications for accreditation as member of an existing Common Bonded Warehouses provided that such prospective member is a manufacturing facility.
SECTION 5. The Chairman, Committee on Bonded Warehouse shall submit to the Commissioner of Customs a list of all pending applications already with the Committee as of close of business hours today, 31 March 2005. The list must be submitted not later than 5PM, Friday, 01 April 2005.
SECTION 6. All other regulations and issuances inconsistent with this Order are deemed repealed or modified accordingly.
SECTION 7. This Order takes effect immediately.
