[ SRA SUGAR ORDER NO. 6, SERIES OF 2009-2010, December 18, 2009 ]

CONVERSION OF œC-1  SUGAR PRODUCED UP TO DECEMBER 6, 2009 OF CROP YEAR 2009-2010, TO œB  SUGAR



WHEREAS, Section 2 (B) of Executive Order No. 18, Series of 1986 mandates the SRA to establish and maintain such balanced relation between production and requirement of sugar and such marketing conditions as will ensure stabilized price levels reasonably profitable to the producers and fair to consumers;

WHEREAS, Sugar Order No. 1, as amended by Sugar Order 1-A, Series of 2009-2010, provided for œC-1  or Strategic Reserve Sugar allocation;

WHEREAS, Sugar Order No. 4, Series of 2009-2010, authorized the conversion of œC-1  sugar to œB  or Domestic sugar produced up to November 8, 2009 of the current crop year;

WHEREAS, withdrawals of domestic raw and refined sugar continued to increase, with raw and refined sugar withdrawals higher by 38% and 15% respectively, compared to  the same period the previous crop year;

NOW THEREFORE, under and by virtue of the authority vested in the Sugar Regulatory Administration (SRA), the following is hereby ordered:

SECTION 1.  Reclassification (Conversion) of œC-1  (Strategic Reserve) Sugar Produced up to December 6, 2009 of Crop Year 2009-2010 to œB  (Domestic) Sugar.

A. All œC-1  or Strategic Reserve sugar produced from weekending November 15, 2009 up to December 6, 2009 only, of Crop Year 2009-2010, are hereby converted to œB  or Domestic sugar.

B. The œC-1  quedan permits covering the sugar subject to conversion, when surrendered to the issuing mill companies for the purpose of withdrawing the corresponding volume of sugar therefrom, shall be stamped œRECLASSIFIED AS œB  OR DOMESTIC SUGAR PURSUANT TO S.O. NO. 6, SERIES OF œ2009-2010  by the SPROs assigned thereat.

C. œC-1  or Strategic Reserve sugar that have been previously converted to œD  or World Market sugar are not covered by this order, in accordance with Section 4.1 of Sugar Order No. 1, Series of 2009-2010.

SECTION 2.  Consistency. Other provisions of Sugar Orders Nos. 1, 1-A, and 4, Series of 2009-2010, not contrary hereto shall remain in full force and effect.

SECTION 3.  Provisions of Sugar Orders, Circular Letters, rules and regulations contrary to or inconsistent with this Sugar Order is hereby revised, modified or revoked.

SECTION 4. This Sugar Order takes effect immediately.
