ESTABLISHMENT OF THE CENTER FOR LAND ADMINISTRATION AND MANAGEMENT-PHILIPPINES (CLAMP)



Pursuant to Executive Order No. 192, series of 1987 granting the DENR the authority to develop operating standards and procedures to enhance its objectives and functions in carrying out the provisions of Commonwealth Act No. 141, otherwise known as œThe Public Land Act , as amended, and other pertinent laws covering the land sector and in consonance with the objectives of the government in reforming the land sector for a more streamlined, efficient and effective land administration and management system, the Center for Land Administration and Management-Philippines (CLAMP) is hereby established.

Section 1. Policy and Objectives - It is the policy of the DENR to institute reforms in the land sector continuously in order to improve its administration and management system. The establishment of CLAMP shall aim to:

A. Integrate all new Land Administration and Management (LAM) innovations and technologies as part of the reform process.

B. Propel the use of these LAM technologies and innovations not only in the DENR but also in the other government agencies with land-related functions; and

C. Sustain the continued and further development of these LAM technologies and innovations.

Section 2. Implementation Structure - Implementation arrangements shall be managed in three levels:

A. Oversight Committee - An Oversight Committee (CLAMP-OC) composed of representatives from the Department and the private sector shall provide strategic directions, management oversight, and resource mobilization support for the Center. This Committee shall be composed of:

1) For the Government Sector:

a) The Undersecretary appointed by the DENR Secretary as Chairman;
b) Directors (or their representatives) of the Land Management Bureau (LMB), Human Resources Development Services (HRDS), Ecosystems Research and Development Bureau (ERDB), Land Registration Authority (LRA), Department of Agrarian Reform (DAR), National Commission on Indigenous Peoples (NCIP), Philippine Reclamation Authority (PRA), and the Administrator of the National Mapping and Resource Information Authority (NAMRIA), as members;

c) The Executive Director (or representative) of the Bureau of Local Government Finance (BLGF), as member;

2) For the Academe Sector:

a) A Dean (or representative) from a Sate College or University that offers courses on Land Administration and Management (LAM), as member; and

3) For the Private Sector:

a) The President (or representative) of the Geodetic Engineers of the Philippines (GEP) as member.

B. National Office - The Land Management Bureau (LMB) shall perform the overall implementation and coordination function for the Center. The National Office shall have the following personnel:

1. A CLAMP Manager who shall be appointed by the Chairman of CLAMP-OC from the existing personnel of the LMB/LMS upon the recommendation of the Director of LMB.

2. An Administrative Officer who shall be appointed by the LMB Director from the existing personnel of the LMB/LMS upon the recommendation of the CLAMP Manager

3. A Knowledge Management Officer with information technology background who shall be appointed by the LMB Director following the Standard Recruitment, Selection and Appointment.

C. Training Field Site - CLAMP ™s Training Field Site shall be initially stationed at the DENR-Region 8 where LAM technology and knowledge were mainstreamed and made operational. A Field Training Site Coordinator and the Office Assistant shall be appointed by the LMB Director upon recommendation of the Regional Executive Director (RED). It may be replicated in other regions upon request of the DENR Regional Office concerned.

Section 3. Duties and Responsibilities - The following shall be the main duties and responsibilities of CLAMP implementers:

Oversight Committee - The CLAMP-OC shall provide policy direction and oversight to the implementation of the programs of the Center. The CLAMP-OC shall:

On Strategy and Direction

1. Review over-all strategy and direction to ensure the continuing relevance of the Center, alignment with government policies, programs and priorities;
2. Review policy recommendations arising from the conduct of its programs;
3. Promulgate policy guidance on appropriate measures to be taken by the Center to address policy gaps and needs;

On Oversight and Coordination

1. Review the Center ™s performance and planned outcomes and identify policy issues that have to be addressed;
2. Establish and build consensus among the participating agencies and stakeholders on policy reforms being instituted;
3. Monitor compliance of participating agencies to their commitments to the Center to achieve its goals; and
4. Confirm the designation of the Center ™s Manager.

B. National Office - The Director of the LMB shall have direct supervision and control over the CLAMP. The National office shall:

1. Perform the function of Secretariat for the Oversight Committee:

a. Work with the CLAMP-OC Chair on the preparation of the agenda for the CLAMP-OC meetings;
b. Facilitate the organization of the meetings and ensure the participation of the members of the CLAMP-OC and representatives of other agencies and stakeholders when necessary; and
c. Document the minutes of the meetings and ensure proper storage and dissemination;

2. Implement the programs of the Center:

a. Review the Center ™s performance and planned outcomes and recommend policy issues to CLAMP-OC;
b. Ensure the relevance of CLAMP and its alignment with government policies, programs, and priorities;
c. Formulate and implement strategies towards CLAMP ™s sustainability; and d. ensure the quality of programs delivered.

3. Coordinate with other offices of the department and other national agencies:

a. Monitor the commitments of agencies and stakeholders to achieve the goals of the Center; and
b. Facilitate the process of getting approval from appropriate agencies on policy issues acted upon by the CLAMP-OC including the issuance of department orders to effect implementation thereof;

4. Formulate and implement resource mobilization strategies for the sustainability of the Center.

C. Training Field Site - The site shall act as the conduit of the National Office for trainings.

Section 4. Funding Arrangement - The Center shall initially operate within the budget structure and system of the department. The LMB shall include the operating budget of the Center in its annual budget plan. The Center shall be allowed to carry out resource mobilization efforts from other sources.

All the DENR Regional Offices and other agencies in the land administration and management sector that will utilize the services of the Center for their trainings, workshops, and other relevant activities shall be required to pay appropriate fees. For this purpose, the Center shall create a trust fund or special account subject to existing accounting rules and regulations.

The training services to be provided by the Center to other government agencies, local government agencies and private entities, shall be covered by a Memorandum of Agreement (MOA).

Section 5. Sustainability Plan - To guide the proper operation of CLAMP and ensure its sustainability, a Business Plan shall be prepared by the LMB that shall detail the phases of its implementation.

Section 6. Core Programs of CLAMP - The Center shall mainstream LAM systems and technologies through the following core programs:

A. LAM Technology Transfer - these technologies shall include, but not be limited to the following: Cadastral Index Mapping (CIM), Systematic Adjudication (SA), One-Stop-Shop (OSS), Cadastral Survey and Records Management, Land Administration and Management System (LAMS), and the systems and processes developed by the Innovation Support Fund (ISF).

B. LAM Technical Trainings - the aforementioned technologies shall be accompanied by technical trainings to ensure the transfer of technology. A pool of experts shall be tapped for the delivery of these trainings; and

C. Technical Advisory - the trainings shall be supplemented by technical advisory to support the adoption of these technologies. The advisers shall come from the pool of experts that shall be capacitated for this purpose.

Section 7. Support Programs of CLAMP - CLAMP shall support its core programs with Advocacy and Linkages that shall focus on Continuing Education and Research Development in LAM and shall make Learning Resources available through its website and library.

Section 8. Effectivity - This Order shall take effect fifteen (15) days after the publication thereof in a newspaper of general circulation and upon acknowledgement of the receipt of a copy thereof by the Office of the National Administrative Register (ONAR).
