ADJUDICATION OF APPREHENSION CASES



In the recent audit conducted by the Internal Audit Division (IAD) on the adjudication of apprehension cases, it was observed that there are rampant confiscated Temporary Operator ™s Permit (TOP) whose violations were œstudent driver not accompanied by a License Holder , œ œno EWD  and œdirty plate . However, verification with the LTO-IT system revealed that no such student permit or unlicensed driver and/or motor vehicles were currently registered.

In view thereof, it is required that upon settling of apprehended TOPS by th erring drivers/operators, she/he must be required to present valid documents, such as student permit/driver ™s license and OR/CR that are considered subnstantial evidence for the Adjudicator to verify if the violations committed or imposed by the Law Enforcement Officers and Deputized Agents are proper. Moreso, the Adjudicating Officer should make use of the available LTO-IT system viewing facility as a guide in making the resolution and to minimize apprehension cases resulting to the unjustified dismissal and/or reduction of fines and penalties due thereon.

Employees violating this regulation shall be subject to appropriate administrative action in accordance with the existing Civil Service Rules and Regulations.
