[ MMDA RESOLUTION NO. 11-21, June 28, 2011 ]

GRANTING THE METROPOLITAN MANILA DEVELOPMENT AUTHORITY (MMDA) THE SOLE AUTHORITY TO MANAGE AND IMPLEMENT FLOOD CONTROL PROGRAMS AND PROJECTS IN METRO MANILA WHETHER FOREIGN OR NATIONAL GOVERNMENT FUNDED PROJECTS INCLUDING THE DEVELOPMENT OF INFRASTRUCTURE PROJECTS ON RIVERS, ESTEROS, CREEKS AND OTHER WATERWAYS TOGETHER WITH THE CAPITAL OUTLAY, PERSONAL SERVICES, MAINTENANCE AND OTHER OPERATING EXPENSES



WHEREAS, after several parts of Metro Manila were submerged in floodwaters due to monsoon rains by tropical storm œFalcon , the Metro Manila Council, the governing body of the Metropolitan Manila Development Authority (MMDA) immediately conducted an emergency meeting on June 28, 2011, to address the perennial problem of flooding in Metro Manila;

WHEREAS, the amount of rain brought by typhoon œFalcon  was more than what Metro Manila ™s drainage system could accommodate and that many of the open waterways in the metropolis were clogged with tons of garbage;

WHEREAS, the widespread flooding in the metropolis that resulted to heavy traffic and left hundreds of people stranded was attributed to the huge amount of rainfall brought by typhoons and monsoon rains during rainy season, clogged drainage systems and unfinished roadwork;

WHEREAS, of the 500-kilometer waterways in Metro Manila, fifty five percent (55%) of which cannot be reached by MMDA ™s equipment due to obstruction and illegal structure of informal settlers on esteros, rivers and other waterways;

WHEREAS, in view of the foregoing circumstances, the Metro Manila Mayors pushed for a review of the existing Memorandum of Agreement entered into by and between the MMDA and the Department of Public Works and Highways (DPWH) on the transfer of flood control management to the MMDA and look into the possibility of using calamity funds of the seventeen (17) Local Government Units (LGUs) of Metro Manila for pre-calamity or pre-disaster activities;

WHEREAS, the present Floodwater Gauge Sensors (FGS) of MMDA used in determining the floodwater levels in Metro Manila during rainy season are not installed in identified flood prone areas, but instead, said FGS are installed only in MMDA ™s pumping stations, and only few of which are functioning;

WHEREAS, to address the lack of FGS, the mayors of Metro Manila agreed to provide additional FGS to MMDA to be installed in flood prone areas of Metro Manila;

WHEREAS, the Metro Manila Council after due deliberation in session duly assembled, agreed to grant the MMDA the sole authority to manage and implement flood control programs and projects in Metro Manila whether foreign or national funded projects including the development of infrastructure projects on rivers, esteros, creeks and other waterways together with the capital outlay, personal services, maintenance and other operating expenses.

NOW, THEREFORE, be it resolved as it is hereby resolved, pursuant to Section 6 of RA 7924, that the Council hereby grants the Metropolitan Manila Development Authority (MMDA) the sole authority to manage and implement flood control programs and projects in Metro Manila whether foreign or national government funded projects including the development infrastructure projects on rivers, esteros, creeks and other waterways together with the capital outlay, personal services, maintenance and other operating expenses.

RESOLVED FURTHER, that the MMDA shall consult with the 17 LGUs of Metro Manila the flood control programs and projects prior to its implementation, whether foreign or national government funded and for the LGUs of Metro Manila to use its calamity funds for pre-calamity or pre-disaster activities;

RESOLVED FURTHERMORE, that the seventeen (17) LGUs of Metro Manila shall provide additional Floodwater Gauge Sensors to MMDA to be installed in flood prone areas of Metro Manila;

RESOLVED FINALLY, that MMDA Chairman Francis N. Tolentino, is hereby designated as the over-all head of Flood Control programs and projects of Metro Manila;

This Resolution shall take effect upon approval.
