[ LTFRB MEMORANDUM CIRCULAR NO. 2005-057, December 20, 2005 ]
REITERATION OF RULE 13 OF THE LTFRB RULES OF PRACTICE AND PROCEDURES
In view of the increasing number of accidents involving Public Utility Vehicles for the past few months, this Board hereby reiterates Rule 13, Sec. 1 of the LTFRB Rules of Practice and Procedures. Pursuant thereto, "The Board may prior to the hearing, suspend for a period not exceeding thirty (30) days any certificate or the exercise of any right or authority issued or granted under the Act or E.O., whenever it is necessary to avoid death, physical injuries, defraudation or public utility users, or willfully or contumaciously refuse to comply with the orders, rules or regulations of the Board, or any provision of the E.O. and the Act."
All the authorized units under the franchise/case number where the involved motor vehicle is included shall be suspended after service of the copy of the order pursuant to aforequoted rule.
Accordingly, all the authorized units under the suspended franchise shall be brought to the Land Transportation Office with Motor Vehicles Inspection System (MVIS) for inspection of the units on roadworthiness. All the drivers of the operators are mandated to undergo Road Safety seminars conducted by the same office.
The lifting of the suspension order shall only be made upon presentation of the respondent-operator of its certificates of compliance with the directive in the immediately preceding paragraph.
This Memorandum Circular supersedes any and all issuances inconsistent herewith, and takes effect immediately.
