CREATING A REWARD COMMITTEE AND PROVIDING GUIDELINES FOR THE GRANT OF REWARDS TO INFORMERS INSTRUMENTAL IN THE SEIZURE OF DANGEROUS AND OTHER RELATED MATTERS



Pursuant to the powers vested in the Dangerous Drugs Board under Section 36 (a) and (o), Article VIII of R.A. 6425, as amended, the following Regulation is hereby promulgated:

SECTION 1. Composition of the Reward Committee - The Rewards Committee shall be composed of the following:

1. Chief Legal Officer of the Board - Chairperson
   
2.1 Representative of the Department of Justice - Member
   
3.1 Representative of the Economic Intelligence and Investigation Bureau - Member
   
4.1 Representative of the Narcotics Command - Member
   
5.1 Representative of the National Bureau of Investigation - Member

The chairperson shall select one (1) member of DDB Secretariat to act as Secretary.

SECTION 2. Observers - The Chief of Financial Management Staff, the Chief Control, Regulation and Intelligence Division and the Resident Auditor shall, upon request of the Committee, attend the meeting as observers.

SECTION 3. Duties/Functions - The Committee shall have the following functions/duties:

1. To pass upon claims for rewards;
2. To draft/amend/revise board regulations
3. To perform other tasks relating to the grant of reward.

SECTION 4. Meetings/Quorum/Manner of Voting - The Reward Committee shall meet at the call of the Chairperson or by two (2) members of at least once a month but not to exceed two (2) meetings in a month.

Three (3) Member shall constitute a quorum. Approval of a claim shall be by unanimous vote of the members thru a resolution.

SECTION 5. Venue - The Committee shall meet at the Office of the Dangerous Drugs Board.

SECTION 6. Honoraria - The members present shall each receive an honorarium in the amount of P250.00 per meeting.

SECTION 7. Proof of Entitlement to a Reward - A claim for reward shall be made in writing, duly signed and under oath by the claimant. For the approval of his claim, documents to be submitted by a claimant shall be as follows:

1. Letter-claim signed either by the informant himself or by the Team Leader of the Law Enforcement Unit responsible for the seizure of the drug subject of the claim.

2. Sworn statement of the Team Leader that informant is not a government employee.

3. Copy of the After Operation Report.

4. Custody Receipt of the Dangerous Drugs seized from either the PNPCL or the NBI.

5. Chemical analysis of the seized dangerous drugs from either the PNPCL, NBI, DDB, or DDB-accredited drug testing laboratories indicating therein the nature and quantity of the substance as well as its percentage of purity.

6. Copy of the Information filed in Court against the person/s arrested and from whom the dangerous drugs were seized, as certified to by the Clerk of Court.

Where no arrest was made, a detailed report on the circumstances attending said seizure shall be submitted together with a statement explaining such non-arrest, in which case, only 50% of the total reward may be paid to the claimant after proper evaluation by the Committee.

SECTION 8. Authority to approve a claim - The Committee shall be authorized to approve a single claim for reward not exceeding P50,000.00. If the single claim for reward exceeds P50,000.00, the same shall be approved by the Dangerous Drugs Board upon recommendation of the Committee.

The amount of P300,000.00 shall be the maximum reward that may be paid to a claimant arising from a single case. However, in no case shall the reward be less than P500.00 for every single claim.

SECTION 9. Mode of Payment - Fifty percent (50%) of the informer's reward shall be paid upon filing of the information in court. The other 50% shall be paid after the prosecution rests its case, as certified to by the Clerk of Court, provided, however that if the amount of reward does not exceed P30,000.00, the same shall be paid in full upon filing of the information in court.

SECTION 10. Prescriptive Period - The right of a claimant to a reward shall prescribe if the claim thereto is not filed within one (1) year from the seizure of the dangerous drugs.

SECTION 11. Pending Claims - All claims previously filed with the Economic Intelligence and Investigation Bureau which have not been acted upon shall be forwarded to the Committee for appropriate action.

SECTION 12. Appropriations - The Board shall set aside the amount of THREE MILLION PESOS (P3,000,000,000.00) to fund claims for reward.

SECTION 13. Separability Clause - Should any provision/provisions of this Regulations be declared unconstitutional or in contravention to R.A. 6425, as amended the remaining provisions shall nevertheless remain enforceable.

SECTION 14. Repealing Clause - All regulations inconsistent herewith are hereby repealed or modified accordingly.

SECTION 15. Effectivity - This regulation shall take effect upon its approval.
