[ MMDA RESOLUTION NO. 07-25, S. 2007, November 22, 2007 ]

REQUESTING THE LAND TRANSPORTATION AND FRANCHISING REGULATORY BOARD TO REQUIRE OWNERS OF PUBLIC UTILITY VEHICLES TO SECURE CLEARANCE FROM THE MMDA AND PERMIT FROM THE CONCERNED LOCAL GOVERNMENT UNITS OF METRO MANILA BEFORE APPLYING FOR A FRANCHISE TO OPERATE



WHEREAS, the yearly increase of public utility vehicles plying along the major and secondary thoroughfares of Metro Manila has contributed to the traffic congestion in some areas which continue to affect the efficiency of the projects/programs on traffic being implemented by the local government units of Metro Manila and the MMDA;

WHEREAS, the upsurge of these vehicles is partly due to the issuance of franchise to operate by the Land Transportation and Franchising Regulatory Board to PUV operators;

WHEREAS. Section 3b of RA 7924 mandates MMDA to manage transport and traffic in Metro Manila, which includes the formulation, coordination and monitoring of policies, standards, programs and projects to rationalize the existing transport operations, infrastructure requirements, the use of thoroughfares and promotions of safe and convenient movement of goods therein;

WHEREAS, RA 7160 known as the Local Government Code of 1991, empowers the LGUs to regulate the use of streets, avenues, alleys, sidewalks, bridges, parks and other public places; regulate garages and the operation of conveyances for hire; establish bus and vehicle stops and terminals and regulate the use of the same by privately-owned vehicles which serve the public;

WHEREAS, it is necessary to adopt measures that will help minimize traffic congestion along Metro Manila's roads/thoroughfares to provide convenience to motorists and pedestrians and further promote the enhancement and development of socio-economic activities that will redound to the attainment of the country's goal for economic stability and sustainable development.

WHEREAS, there is now an urgent need to regulate the issuance of franchise o PUVs to ensure that the transport and traffic management plans of the MMDA and the seventeen (17) local government units (LGUs) will not be affected and will not undermine the efficiency and effectiveness of the programs, projects and activities designed to improve Metro Manila's traffic condition;

WHEREAS, the Metro Manila Council (Council), in session duly assembled, after due deliberation recognized the need to request the LTFRB to require owners of PUJs/ pUVs to secure clearance from the MMDA and permit from the concerned LGUs of Metro Manila before applying for a franchise to operate in a certain area.

NOW, THEREFORE, be it resolved as it is hereby resolved, pursuant to Section 6 of RA7924, that the Council hereby requests the LTFRB to require owners of PUJs/PUVs to secure clearance from the MMDA and permit from the concerned LGUs of Metro Manila before applying for a franchise to operate.

This Resolution takes effect upon approval.
