[ PNP NHQ PNP CIRCULAR NO. 2007-003, February 20, 2007 ]
AMENDING SUB-PARAGRAPH 3 OF PARAGRAPH V, NHQ PNP CIRCULAR 2002-001 DATED JANUARY 01, 2002 ENTITLED "PAYMENT OF RETIREMENT BENEFITS OF PNP PERSONNEL (RETIREES) WITH PENDING CASES"
Whereas, the PNP issued on January 7, 2002 Circular No. 2002-001 entitled "Payment of Retirement Benefits of PNP Personnel (Retirees) with Pending Cases" which provides under Sub-paragraph 3 of Paragraph V for the requirements of a guarantor;
Whereas, the DPRM recommended the amendment of said provision due to its strict requirement and rigidity of its application as to similarly require third level rank Officers to secure a guarantor of same rank or higher with at least five (5) years more of remaining service before compulsory retirement;
Whereas, majority of Officers who reaches the third level ranks have less than five (5) years of active service before their compulsory retirement, therefore, it would be very hard for them to look for a guarantor within their level;
Whereas, the need to amend such requirement is but appropriate, fair and equitable;
Whereas, there is a ree6 to limit the number of times that any personnel may act as guarantor to protect the interest of the aggrieved parties, prevent multiplicity of suits or claims involving same parties and prevent complexity in the processing of benefits;
Whereas, the PNP, after careful evaluation of the facts and circumstances, determines the amendment of Sub-paragraph 3 of Paragraph V, NHQ PNPCircular2002-001 necessary and in order;
NOW, THEREFORE, the CPNP, pursuant to the inherent powers vested in him by his position and designation has resolved to amend, AS HE HEREBY AMENDS Sub-paragraph 3 of Paragraph V NHQ PNP Circular 2002-0001, to wit;
Sub-paragraph 3 Paragraph V, NHQ PNP Circular 2002-001 is hereby amended to read as follows:
Section 3, "If the penalty prescribed is prision mayor or higher, no payment of retirement benefits shall be made unless a PNP personnel of equal rank or higher than that of the retiree and with at least five (5) years more in the service before compulsory retirement shall act as guarantor. Provided that if the retiree belongs to the third level ranks, the guarantor must have at least one (1) year more in the service before compulsory retirement".Adopted: 20 Feb. 2007
"Provided further that no PNP personnel shall act as guarantor more than once and no one shall be allowed to act as guarantor for the second or third time or often unless and until the previous case to which he/she acted as ."' guarantor, shall have been finally resolved and the obligations arising therein completely settled".
