[ PRESIDENTIAL DECREE NO. 1589, June 11, 1978 ]
EXCLUDING CERTAIN AREAS FROM THE OPERATION OF PROCLAMATION NO. 87 DATED AUGUST 9, 1966, UNDER REPUBLIC ACT NO. 3092, AND OPENING THE SAME FOR MINING PURPOSES.
WHEREAS, pursuant to Section 3(O) of Commonwealth Act No. 136, the President of the Philippines issued Executive Order No. 245 dated July 10, 1970 prescribing the procedures of mineral prospecting and exploitation in government reservations other than mineral reservations;
WHEREAS, in accordance with Executive Order No. 245 and Presidential Decree No. 463, Baler Consolidated Mines, Inc. applied for and was duly granted, first a Prospecting Permit by the Bureau of Forest Development and subsequently, an Exploration Permit by the Bureau of Mines, over a certain parcel of Dibudalan Mountain Forest Reserve located at Barrio Dibut, Municipality of Baler, Sub-province of Aurora, Province of Quezon;
WHEREAS, various investigations, exploration works and feasibility studies caused to be undertaken by applicant Baler Consolidated Mines, Inc. and verified by the Bureau of Mines revealed that the applied area is more valuable for mining purposes than the purpose for which it has been reserved, and that the chromite deposit therein could be commercially exploited; and
WHEREAS, applicant Baler Consolidated Mines, Inc. after having complied with the requirements under Executive Order No. 245, Series of 1970, and under the Mineral Resources Development Decree of 1974, otherwise known as P.D. 463, now requests the exclusion of the applied area from the forest reservation;
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, hereby decree and order that a parcel of land within the Dibudalan Mountain Forest Reserve established under Proclamation No. 87 dated August 9, 1966 (R.A. No. 3092), be excluded from the operation of said Proclamation and hereby award the development and exploitation and utilization of the chromite deposits and other minerals found therein to Baler Consolidated Mines, Inc. subject to existing rights, if any there be, and to existing policies, laws, rules and regulations pertinent thereto, which parcel of land is particularly described as follows:
Beginning at point "1" which is S 39° 10' E., 4,328.31 meters from BLLM No. 39, Baler Cadastre, Municipality of Baler, Province of Quezon; thence S 0°10' E., 1,844.15 meters to point 2; thence S 89°50 min. W., 1,786.64 meters to point 3; thence N 0°10 min. W., 1,844.14 meters to point 4; thence S. 89°50 min. W., 893.21 meters to point 5; thence N 0°10 W., 2,766.36 meters to point 6; thence N 89°50 min. E., 1,786.40 meters to point 7; thence S 0°10 min. E., 922.11 meters to point 8; thence N 89°50 min. E., 1,786.42 meters to point 9; thence S 0°10 min. E., 1,844.22 meters to point 10; thence S 89°50 min. W., 893.2 meters to point 1 which is the beginning, containing an area of One Thousand One Fifty Three & 1519/10,000 (1,153.1519) hectares, more or less, as indicated in the attached Plan of the Boundary Survey.
This Decree takes effect immediately.
