[ CSC MEMORANDUM CIRCULAR NO. 40, s. 1993, September 23, 1993 ]
REPEAL OF CSC RESOLUTION NO. 87-104 DATED APRIL 21, 1987 ON CREDITABLE SERVICES
It has been noted that in CSC Resolution No. 87-104 dated April 21, 1987, the Commission has considered as creditable those services rendered by government officials and employees on contractual, emergency or casual status, subject to the conditions, among others, that the said services are on full-time basis and rendered prior to June 22, 1984, the effectivity date of Executive Order No. 966.
There is a need to repeal the said Resolution because as contemplated in Section 4(b) and Section 7(a) of Executive Order No. 966, all services under contractual, emergency or casual status only after June 22, 1984 and not prior thereto should be considered creditable.
In view thereof, those services rendered by government officials and employees on contractual, emergency or casual status, irrespective of the mode or manner of payment therefor, shall be considered as creditable services for purposes of retirement, subject to the following conditions:
1. Said services are supported by duly approved appointments, official records and/or other competent evidence. Parties/agencies concerned shall submit the necessary proof of said services;
2. Said services are rendered after June 22, 1984, the effectivity date of EO 966.
3. The services for the three (3) years period prior to retirement are continuous and fulfill the service requirement for retirement.
The services of officials/employees on contractual, emergency, or casual status rendered prior to June 22, 1984, which were already credited as government service prior to the issuance of this Resolution, shall no longer be disturbed.
CSC Resolution No. 87-104 dated April 21, 1987 is hereby repealed.
This Memorandum Circular shall take effect immediately.
