AMENDING BOARD REGULATION NO. 3, SERIES OF 2003, ENTITLED "COMPREHENSIVE GUIDELINES ON IMPORTATION, DISTRIBUTION, MANUFACTURE, PRESCRIPTION, DISPENSING AND SALE OF, AND OTHER LAWFUL ACTS IN CONNECTION WITH, ANY DANGEROUS DRUGS, CONTROLLED PRECURSORS AND ESSENTIAL CHEMICALS AND OTHER SIMILAR OR ANALOGOUS SUBSTANCES"



WHEREAS, the Dangerous Drugs Board promulgated Board Regulation No, 3, Series of 2003 providing for the Comprehensive Guidelines on importation, distribution, manufacture, prescription, dispensing and sale of, and other lawful acts in connection with, any dangerous drugs, controlled precursors and essential chemicals and other similar or analogous substances;

WHEREAS, there is a need to amend the aforesaid guidelines to clarify the regulatory fees for the import, export, transit or redirection of dangerous drugs, controlled precursors and essential chemicals, or their preparations;

WHEREFORE, be it RESOLVED, as it is hereby RESOLVED, to amend Board Regulation No. 3, Series of 2003, as hereunder provided:

SECTION 1. Sub-paragraph c(ii)(g) of Paragraph 8 of Section 6, Article III of Board Ke9ulation No. 3, Series of 2003, which reads as follows;
"9; Controlled chemicals - P 0.01 per 1000 grams or a fraction thereof." is hereby deleted.
SECTION 2. Section 10, Article III of Board Regulation No. 3, Series of 2003, is hereby amended by adding a paragraph which reads as follows:
"3. A regulatory fee shall be paid for every application for permit for import, export transit or redirection of dangerous drugs, controlled precursors and essential chemicals or their preparations, as follows:

a.
Five Hundred (P 500.00) Pesos when the quantity of the dangerous drugs controlled precursors and essential chemicals, or their preparations is 1,000 kilograms or liters or less, as the case may be;
 
b.
One Thousand (P1,000.00) Pesos when the quantity of the dangerous drugs controlled precursors and essential chemicals, or their preparations is more than 1,000 kilograms or liters but less than 5,000 kilograms or liters, as the case may be; and
 
c.
One Thousand Five Hundred (P 1,500.00) Pesos when the quantity of the dangerous drugs, controlled precursors and essential chemicals, or their preparations is 5,000 kilograms or liters or more, as the case may be."
SECTION 3. This Regulation shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation and after its registration with the Office of the National Administrative Register (ONAR), UP Law Center, Quezon City.
