INCLUSION OF AMINEPTINE IN THE LIST OF DANGEROUS DRUGS
WHEREAS, pursuant to Section 93, Article XI of Republic Act No. 9165, otherwise known as the Comprehensive Dangerous Drugs Act of 2002, the Dangerous Drugs Board (DDB), after due notice and public hearing, is given the power to reclassify, add to or remove from the list of dangerous drugs any drug or substance;
WHEREAS, under the same section of the said law, the Board, in the exercise of this power, shall take into accord its obligations and commitments to international treaties, conventions and agreements to which the Philippines is a signatory;
WHEREAS, Amineptine is an anti-depressant which has limited therapeutic usefulness but high potential for abuse;
WHEREAS, the United Nations Commission on Narcotic Drugs (CND), through CND Declaration 46/1, has classified Amineptine as a dangerous drug as defined in RA9165;
WHEREAS, during the public hearing held by the DDB Committee on Public Hearings on May 6, 2008, after due notice, no opposition was raised to the proposed inclusion of Amineptine in the list of dangerous drugs;
WHEREFORE, be it RESOLVED, as it is hereby RESOLVED, to include AMINEPTINE ln the list of dangerous drugs and any material, compound, mixture or preparation which contains any quantity of AMINEPTINE, including its salts, isomers, and salts of isomers Within the specific chemical designation, by whatever official, common, unusual or brand name or designation, is classified as a dangerous drug which shall be subject to all regulatory and control measures as provided under RA 9165 and the rules and regulations of the Board, provided that this Regulation shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation and after its registration with the Office of the National Administrative Register (ONAR), UP Law Center, Diliman, Quezon City.
