[ PRC PROFESSIONAL REGULATORY BOARD FOR CUSTOMS BROKERS RESOLUTION NO. 03, S. 2009, November 11, 2009 ]
POLICY REQUIRING REGISTERED AND LICENSED CUSTOMS BROKERS TO SUBMIT VALID CERTIFICATES OF CHAMBER OF CUSTOMS BROKERS, INC. (CCBI) MEMBERSHIP AND OFFICIAL RECEIPTS FOR ANNUAL/LIFETIME MEMBERSHIP DUES AS A PREREQUISITE FOR ISSUANCE OF CERTIFICATES OF REGISTRATION AND PROFESSIONAL IDENTIFICATION CARDS AS CUSTOMS BROKER OR FOR RENEWAL OF THE FOREGOING CARDS
WHEREAS, Sec. 31, Accredited Professional Organization, Art. IV of R.A. No. 9280, known as Customs Brokers Act of 2004, states, to wit:
Section 31. Accredited Professional Organization. - All Professional customs brokers shall have one national organization, which shall be recognized by the Board of the Commission as the one and only accredited professional organization of customs brokers. A professional customs broker duly registered with the Board shall automatically become a member of the accredited professional organization of customs brokers and shall receive the benefits and privileges appurtenant thereto. Membership in the accredited professional organization of customs brokers shall not be a bar to membership in other associations of customs brokers.
WHEREAS, Board Res. No. 3, Series of 2008, the Accreditation of the Chamber of Customs Brokers, Inc. (CCBI) as the one and only Accredited Professional Organization of Customs Brokers, was issued and published on November 8, 2008 in Manila Bulletin, Annex A ;
WHEREAS, there is a need to bind all registered and licensed Customs Brokers who are automatic members of the CCBI under the law and the Implementing Rules and Regulation (IRR) to register with the CCBI as members thereof and to pay the membership fees and dues thereto;
WHEREAS, the submission of Certificate of CCBI Membership together with the Official Receipt of the membership fees and annual dues before the issuance of the Certificate of Registration and Professional Identification Card or the renewal of the foregoing card will address the eventual membership with CCBI and the payment thereto of the membership dues by those registered and licensed Customs Brokers who are not yet bonafide members at the time of the said issuance or renewal; and
WHEREAS, the payment of the membership fees to the APO by the members thereof has been viewed by the Secretary, Department of Justice as in order;
NOW, THEREFORE, the Board hereby RESOLVES, as it is hereby RESOLVED, to require a registered and licensed customs broker to submit his/her valid certificate of CCBI membership bearing, among others, his/her CCBI membership number together with the official receipt of payment for his/her CCBI membership dues (lifetime or annual), prior to issuance of the Certificate of Registration and Professional Identification Card or to the renewal of the foregoing card.
RESOLVED, FURTHER, that the President of CCBI furnish the PRC Registration Division a copy of the updated official registry of bona-fide Customs Brokers members indicating their membership and annual or lifetime dues official receipts numbers;
RESOLVED, FURTHERMORE, that the Commission provide quarterly a copy of the latest list of Registered and Licensed Customs Brokers.
This Resolution shall take effect after fifteen (15) days following its full and complete publication in the Official Gazette, or any major daily newspaper of general circulation in the Philippines.
Let copy hereof be furnished to the Registration Division, the Chamber of Customs Brokers, Inc. (CCBI) and the PRC Regional Directors/OICs for dissemination to all concerned.

No part, consistent with previous inhibition as to matters delving on the issue as to whether the Chamber of Customs Brokers, Inc. is the legitimate and duly accredited professional organization of Licensed Customs Brokers.
