[ LTFRB MEMORANDUM CIRCULAR NO. 2008-005, April 02, 2008 ]
BOARD'S POLICY ON APPLICATION FOR EXTENSION OF VALIDITY OF EXPIRED CERTIFICATE/S OF PUBLIC CONVENIENCE
Due to the clamor of holders of Certificates of Public Convenience, and in the interest of the public transport service, this Board hereby allows late filing of applications for extension of validity of expired CPC, subject to the following terms and conditions:
4.1 Jitneys and Sedans
PPhP500.00/unit
4.2 AUVs, Vans, Coasters and Mini Buses
Php750.00/unit
4.3 Buses and Trucks
Php1,000.00/unit
For denominations/services with AUV Vehicles as their authorized units, only holders of CPC with converted franchises to GT services may avail of the late filing of Application for Extension subject to the same terms and conditions as above enumerated insofar as they are applicable.
Holders of Certificate of Public Convenience covered by this Memorandum Circular and will avail of the privilege are given until 31 DECEMBER 2008 to file Application/Petition for Extension of Validity.
However, in case the last day of filing falls on Saturdays, Sundays, holidays or non working days, wherein transaction to the government is not available, the applicant may file on the next working day without any imposable penalty.
Expired Certificate/s of Public Convenience not covered by this Memorandum Circular shall not be allowed to file Application for Extension of Validity, except on justifiable reason and circumstances, and subject to the sound discretion of this Board.
All issuances inconsistent herewith are hereby superseded and amended accordingly
This Memorandum Circular shall take effect immediately.
Adopted: 02 April 2008
- It shall be allowed in all denominations, with some modifications to other denominations with AUV units;
- It shall cover Certificates of Public Convenience issued by the Central Office and all Regional Offices which expired from 01 JANUARY 2005;
- The regular penalty for late filing in the amount of FIVE HUNDRED PESOS (PhP500.00) per unit and per month shall be charged;
- In addition to the above-mentioned regular penalty, the following penalty shall also be imposed:
