AMNESTY PROGRAM FOR SHUTTLE SERVICE PROVIDERS FOR WORKERS WITHIN CLARK SPECIAL ECONOMIC ZONE



After a dialogue with the officials of Clark Development Authority and the representative-investors of Clark Investors and Locators Association, an Amnesty Program was recommended, taking into account the economic implication thereto, to legitimize the operations of Shuttle Service providers for employees working within the Clark Special Economic Zone. In the interest of public service and pursuant to Department Order No. 2005-010 setting forth the Policy Guidelines on the Exercise of Authority and Functions by this Board and empowering it to issue Memorandum Circulars governing the powers and functions provided for in Section 5 of Executive Order 202, the Board hereby issues an Amnesty Program for Shuttle Service providers with the use of any vehicle with a seating capacity of at least twenty-four (24) passengers or above for workers employed by investor-companies based at Clark Special Economic Zone, subject to the following requirements and conditions, in addition to the existing policies.

    1. Contract of Shuttle Service between the company and the applicant.

    2. Name, address, contact number and designation of the authorized signatory of the company and Board Resolution or Secretary ™s Certificate authorizing the signatory to sign for and in behalf of the company.

    3. Certification from Clark Development Authority that the company is duly authorized to do business within the economic zone.

    4. Every unit proposed for operation must be cleared from colorum apprehension by the Land Transportation Office.

    5. The whole body of the unit proposed for operation must be painted with an LTFRB assigned color based on its base of operation:

      a) Brown - For Pampanga
      b) Blue - For Tarlac

    6. The marking œCLARK SHUTTLE SERVICE  with 12  x 12  (height and width) lettering size shall be painted in white color at the right and left sides of the unit.

    7. All units shall be inspected by Regional Office No. III before the Approval of the Application.

    8. The following Amnesty Fee for each unit applied shall be paid upon the filing of the Application, which amount does not include the regular fees and charges of the Board:

                           
    a) One colorum Apprehension PhP5,000.00
    b) Two Colorum Apprehension PhP7,500.00
    c) three or more Colorum Apprehensions PhP10,000.00

    9. In case of any Opposition filed to contest the Application, the Board shall adopt a summary proceeding by directing the parties concerned to file their respective Position Paper within a non-extendible period of ten (10) days from the date of hearing of the said Application. Thereafter, the case shall be submitted for resolution.

    10. No Applications for Dropping and Substitution of Unit, and Sale and Transfer of the approved Applications shall be allowed within one (1) year from grant thereof.

    11. Interested applicants are given until 30 April 2006 from effectivity of this Circular to avail of the herein Amnesty Program

This Memorandum Circular supersedes any and all issuances inconsistent here- with, and takes effect immediately following its publication in a newspaper of general circulation and the filing of three (3) copies hereof with the UP Law Center, pursuant to Presidential Memorandum Circular No. 11, dated 09 October 1992.
