IMPLEMENTING GUIDELINES IN THE REGISTRATION OF REPOSITIONED RIGHT TO LEFT HAND DRIVE TRUCKS



By virtue of the provision of Sec. 4 (d-1) of R.A. 4136 and in compliance to DOTC Department Orders Nos. 95-847, 94-806 and 94-289 the following guidelines are hereby promulgated in the registration and operation of trucks repositioned from right to left hand drive:

1.0 All right hand drive trucks shall be repositioned to left hand drive prior to registration in compliance to the Philippine National Standard PNS 1259-1994 "Requirements for Repositioning Right Hand Drive (RHD) to Left Hand Drive (LHD) on Road Vehicles"

1.1 Conversion done by a DTI-PNS accredited shop shall be accompanied by a Certificate of Warranty signed by the Manager of said shop. Those done by persons NOT accredited by DTI-PNS shall be accompanied by an Affidavit of Undertaking jointly signed by the registered owner and the mechanic who supervised and/or did the conversion guaranteeing conformance to standard as established and answerable for any civil liability.

1.2 All Motor Vehicle Inspectors shall conduct mandatory ocular inspection to ensure that defects, if any, are corrected by the owner of the vehicle. On the face of the MVIR form at left hand blank space for the inspector's printed/stamped name and signature the words "Repositioned from right to left hand drive - Inspected". The registration clerk shall type "Repositioned RHD to LHD" in the portion for BOC/BIR CP Nos. of the MVRR.

2.0 The following schedule shall be strictly observed:

2.1 Conditional renewal under deposit shall continue; however, the validation stickers shall NOT be issued until proof conversion is presented.

Pursuant to Sec. 16 in relation to Sec. 37, a right hand drive vehicle found NOT complying with the conversion schedule even if already registered shall be subject to technical impounding through the confiscation of its license plates and upon 72 hours notice to its owner, suspend such registration until the defects are corrected and/or the minimum standards and specifications are complied with.

2.2 Any personnel who caused or participated in the registration of a right hand drive vehicle in violation of this order shall be administratively charged according to existing Civil Service rules and regulations.

3.0 This order shall take effect 15 July 1995.
