[ GSIS RESOLUTION NO. 88, S. 2010, June 23, 2010 ]

REVISED IMPLEMENTING RULES AND REGULATIONS OF RA 8291



RESOLVED, to APPROVE and CONFIRM the Proposed Revised Rules and Regulations (IRR) of RA 8291, the GSIS Act of 1997, subject to the submission to the Corporate Secretary of the final version of the said IRR, incorporating the following amendments by the Board.

1. Section 3, Exclusion from Compulsory Coverage, Numbers 3.1.2, 3.1.3, and 3.1.4

Change the phrase œnot receiving compensation  to œnot receiving fixed monthly compensation. 

2. Section 11, Amounts of Contribution, Number 11.1

Indicate that the acronym PS stands for œpersonal share. 

Indicate the amounts of contribution for the personal and government shares which are 9% and 12% respectively.

3. Section 15, Penalties on Delayed Remittance

In the title, change the word œpenalties  to œinterest. 

4. Section 23.2.1, Permanent Total Disability (PTD) and Section 23.2.2, Permanent Partial Disability (PPD)

In the list of disabilities, include as the last item for each œsuch other cases as may be determined by the GSIS  as provided in RA 8291.

5. Section 24.5, Conditions for Entitlement to Survivorship Benefits

Add the qualification that dependents must be living together with the member or pensioner.

Clarify the phrase œnot gainfully employed  by adding œas defined in Section 2 (p) of RA 8291. 

6. Section 26, Committee on Claims

Add a provision that the Committee on Claims shall report to the Board on a regular basis on its actions taken.

7. Typographical errors such as but not limited to the correct spelling of the word œstricken  in Section 66 and the proper capitalization of the name œOfficial Gazette  in Section 68.

A copy* of the Proposed Revised Implementing Rules and Regulations (IRR) of RA 8291, reflecting the foregoing changes, is attached and made an integral part hereof.

RESOLVED FURTHER, to NOTE the qualified affirmative vote of Trustee Jesse H.T. Andres to approve the Proposed Revised Implementing Rules and Regulations (IRR) of RA 8291, the GSIS Act of 1997.

Trustee Andres proposes to review, in the light of pertinent provisions under Executive Order No. 209 dated 6 July 1987, the Family Code of the Philippines, the provisions concerning survivorship benefits in relation to the disqualification of the dependent spouse who is gainfully employed from receiving survivorship benefits.

RESOLVED FINALLY, to DIRECT the Corporate Services Officer V, Public Relations and Communications Office, as follows:

1. Publish the Revised IRR of RA 8291 in the Official Gazette or in at least two (2) newspapers of general circulation.

2. Conduct an information campaign to explain to GSIS members the disability benefits under the Revised IRR of RA 8291.
