[ PRC PROFESSIONAL REGULATORY BOARD FOR MARINE ENGINEER OFFICERS RESOLUTION NO. 88, S. 2011, June 01, 2011 ]
DIRECTING THE SUSPENSION OF THE IMPLEMENTATION OR EXECUTION OF RES. NO. 39, SERIES OF 2008
WHEREAS, the Professional Regulatory Board for Marine Engineer Officers, hereinafter called the Board, issued on October 22, 2008 Res. No. 39, Series of 2008, subject to the approval by the Professional Regulation Commission, hereinafter called the Commission, entitled: Policy Requiring Registered and Licensed Marine Engineer Officers to Submit Valid Certificates of Marine Engineer Officers Association of the Philippines, Inc. (MEOAP) Membership and Official Receipts for Annual/Lifetime Membership Dues as a Prerequisite for Issuance of Certificates of Registration and Professional Identification Cards as Marine Engineer Officers or for Renewal of the Foregoing Cards ;
WHEREAS, the said Resolution states, to wit: RESOLVED FURTHER, that the President of MEOAP furnish the PRC Marine Engineer Officers Division (MEOD) a copy of the updated official registry of bona-fide MEOAP members indicating their membership and annual or lifetime, dues official receipt numbers ; nonetheless, this foregoing requirement has not been complied with;
WHEREAS, the MEOAP has been issuing not official receipts of payments but computer generated provisional receipts;
WHEREAS, holding that the aforesaid papers are required for submission to the Commission prior to issuance of the Certificates of Registration and Professional Identification Cards, or to the renewal of the foregoing cards, there is an urgent and valid need for the President of MEOAP to fully meet the aforementioned Resolution s requirements; accordingly, the mere submission of the computer generated provisional receipts of payment cannot be considered as in compliance therewith;
WHEREAS, in addition to the information it received from the maritime industry that MEOAP has ceased to be integrated with other associations of marine engineer officers, as mandated by law, the Board has received complaints from members of the Marine Engineer Officers Association of the Philippines, Inc. (MEOAP) that it is not complying with Resolution No. 39, series of 2008, specifically, the issuance of an official receipt as proof for payment of membership fees or dues therein but instead a computer generated provisional receipts of payment in the amount of P2,000.00/member for five-year membership validity has been practiced since January, 2009;
WHEREAS, in a letter dated March 21, 2011, the Board, as a standard procedure in all quasi-judicial agencies of the national and local governments, required MEOAP to reply on the issue raised in the February 25, 2011 letter of three hundred eighty nine (389) marine engineer officers who are members of MEOAP within a non-extendible period of ten (10) days from receipt thereof;
WHEREAS, the Board, likewise, required in the aforesaid letter of March 21, 2011 that MEOAP, an accredited and integrated professional national organization for marine engineer officers, to show proof that it has complied with the Rules specified in Resolution No. 178, series of 2004, and Resolution Nos. 362 and 363, both series of 2006, as part of the Board s recommendation to the Commission, and that it has maintained all the qualifications and none of the disqualifications for accreditation;
WHEREAS, in a letter dated March 24, 2011, instead of complying with the directive of the Board, MEOAP moved for the inhibition of the members of the former in acting on the said February 25, 2011 letter of the marine engineer officers without squarely addressing the issue raised therein; and
WHEREAS, MEOP also intimated in the aforesaid letter that it will file its answer to or comment on the letter of the Board and of the concerned Filipino Marine Engineer Officers within ten (10) days from March 21, 2011 despite the directive of the Board to reply/comment within a non-extendible period of ten (10) days from receipt of the letter of the Board; however, to date, MEOAP has failed to file their reply thereto/comment thereon.
NOW, THEREFORE, the Board RESOLVES, as it hereby RESOLVED, to direct the SUSPENSION of the implementation or execution of Resolution No. 39, series of 2008, entitled Policy Requiring Registered and Licensed Marine Engineer Officers to Submit Valid Certificates of Marine Engineer Officers Association of the Philippines, Inc. (MEOAP) Membership and Official Receipts for Annual/Lifetime Membership Dues as a Prerequisite for Issuance of Certificates of Registration and Professional Identification Cards as Marine Engineer Officers or for Renewal of the Foregoing Cards until compliance by the President of MEOAP with the requirements on submission of the PRC Marine Engineer Officers Division (MEOD) of a copy of the updated official registry of bona-fide MEOAP members, indicating their membership and annual or lifetime dues of official receipts member, in lieu of the computer generated provisional receipts of payments for such membership fees or dues.
Let copy of this Resolution be furnished the U.P Law Center, the Officer-in-Charge, Marine Engineer Officers Division (MEOD), the Marine Engineer Association of the Philippines, Inc. (MEOAP) and the PRC Regional Directors/OICs for dissemination to all concerned.
This Resolution shall take effect after fifteen (15) days following its full and complete publication in the Official Gazette or any major daily newspaper of general and national circulation in the Philippines.
