AMENDMENT TO SUGAR ORDER NO. 9, SERIES OF 2010-2011 RE: ADVANCE SWAPPING OF CROP YEAR 2010-2011 œB  OR DOMESTIC SUGAR TO œA  OR U.S. MARKET SUGAR



WHEREAS, Sugar Order No. 9, series of 2010-2011 provided for advance swapping of Crop year 2010-2011 œB  or domestic sugar to œA  or U.S. market sugar;

WHEREAS, the volume of verified œA  quedans for shipment to the U.S. and advance swapping of the œB  or domestic sugar into œA  U.S. market sugar has reached 178,000 metric tons and 94,000 metric tons, respectively, or a total of 272,000 œA  U.S. market sugar as of May 23, 2011,  which is more than enough to fully serve the total U.S. allocation for the current crop year;

WHEREAS, there is a need to amend Section 1.b of Sugar Order No. 9, Series of 2010-2011 relative to the deadline of application of June 17, 2011 for the advance swapping of crop year 2010-2011 œB  domestic sugar into œA  or U.S. market sugar;

NOW, THEREFORE, under and by virtue of the authority vested in the Sugar Regulatory Administration (SRA), the following is hereby ordered:

Section 1. Section 1.b under Section 1 of Sugar Order No. 9, series of 2010-2011 is hereby amended to read as follows:

œSection 1. b All outstanding œB  sugar quedan-permits issued in Crop Year 2010-2011 are hereby allowed (eligible), on a voluntary basis, for advance swapping into œA  or U.S. Quota Sugar for Quota Years 2010-2011 and 2011-2012. Applications for advance swapping shall be accepted from the issuance of this Order until May 27, 2011. 

Section 2. Other provisions of Sugar Order No. 9, Series of 2010-2011 shall remain in full force and effect.

Section 3. This Sugar order shall take effect immediately.

Section 4. Provisions of Sugar Orders, Circular Letters, and rules and regulations contrary or inconsistent with this Sugar Order are hereby revised, modified or revoked accordingly.

Section 5. This Sugar Order takes effect immediately.
