[ TESDA RESOLUTION NO. 2010-19, November 25, 2010 ]
APPROVING THE AMENDMENT OF THE TRAINING REGULATIONS FOR THE MARITIME DECK AND ENGINE RATINGS (RATING FORMING PART OF NAVIGATIONAL WATCH (STCW REGULATION II/4), ABLE SEAFARER DECK (STCW REGULATION II/5), RATING FORMING PART OF ENGINEERING WATCH (STCW REGULATION III/4), AND ABLE SEAFARER ENGINE (STCW REGULATION III/5)
WHEREAS, TESDA Board Resolution Nos. 2005-003 and 2006-09 were issued approving and promulgating the Training Regulations for Deck Seafaring NC levels I, II and III and Engine Seafaring NC levels I. II and III;
WHEREAS, the Philippines, as member-state of the International Maritime Organization (IMO) is under obligation to conform to its maritime standards, in particular to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (STCW) and its amendments and the Seafarers Training, Certification and Watchkeeping Code;
WHEREAS, since then, there have been numerous queries, complaints and recommendations to amend the above-mentioned Training Regulations for the Deck and Engine Ratings to be more responsive to the needs of the maritime labor market and to the stipulations of the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (STCW 95) and its amendments including those adopted in the Manila Diplomatic Conference in June 2010;
WHEREAS, the Philippines has deployed around two hundred twenty thousand (220,000) seafarers to the global seafaring industry consisting of twenty percent (20%) of the global seafarers and non-compliance with the STCW may displace a large portion of the deployed Filipino seafarers, making the revision of the Maritime Training Regulations to conform with the latest revision of the STCW, referred to as the Manila amendments to the STCW convention both timely and necessary;
WHEREAS, the Maritime Industry Expert Panel, with the assistance of the Qualification and Standards Office (QSO) of TESDA, has recommended the amendments to the existing Training Regulations of the Maritime qualifications and competencies;
WHEREAS, during the 43rd Standards-Setting and Systems Development (SSS-D)-TESDA Board-TESDA Secretariat Committee Meeting held on 23 November 2010, the Committee favorably endorsed the amendment and reconfiguration of the above-mentioned maritime training regulations (TRs) into the following:
WHEREAS, during the 74th EXCOM-TESDA Board Meeting on 24 November 2010, the Committee agreed to recommend for approval and promulgation the amendment and reconfiguration of the Training Regulations for the Maritime Deck and Engine Ratings;
WHEREAS, in the 76th TESDA Board Meeting on 25 November 2010 at 2:00 p.m., the TESDA Board considered the proposed amendments and approved the promulgation of the Training Regulations for Ratings Forming Part of Navigational Watch (STCW Regulation II/4), Able Seafarer Deck (STCW Regulation II/5), Rating Forming Part of Engineering Watch (STCW Regulation III/4), and Able Seafarer Engine (STCW Regulation III/5) to replace the Maritime Training Regulations under TESDA Board Resolution Nos. 2005-03 and 2006-09;
WHEREAS, the aforesaid Training Regulations are hereto annexed and made an integral part of this resolution;
NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, that the TESDA Board in its Meeting today, 25 November 2010 at 2:00 p.m., approves the aforementioned amendments to the Training Regulations for Maritime Deck and Engine Ratings, particularly the promulgation of the Training Regulations for Rating Forming Part of Navigational Watch (STCW Regulation II/4)* Able Seafarer Deck (STCW Regulation II/5)* Rating Forming Part of Engineering Watch (STCW Regulation III/4)* and Able Seafarer Engine (STCW Regulation III/5)*
BE IT RESOLVED FINALLY, that copies of this Resolution and Training Regulations be published and disseminated to all concerned, and the same shall be effective fifteen (15) days upon publication. All programs registered under these training regulations must comply with the requirements of the aforementioned training regulations. Graduates of TVET courses covered by the aforementioned training regulations shall be required to undergo mandatory assessment under the national assessment and certification program. All programs registered under the current maritime Training Regulations will be required to migrate to the new Maritime Training Regulations within one (1) year from the date of effectivity of this resolution.
