[ PRC BOARD FOR PROFESSIONAL TEACHERS BOARD RESOLUTION NO. 306, S. 2005, September 08, 2005 ]
GUIDELINES ON THE ISSUANCE OF A SPECIAL/TEMPORARY PERMIT TO PARA-TEACHERS PURSUANT TO R.A. NO. 7836 AS AMENDED BY R.A. NO. 9293
WHEREAS, Sec. 2 of R.A. No. 9293 amended Sec. 26, Art. III of R.A. No. 7836, the Philippine Professionalization Teachers Act of 1994 , whose third paragraph reads, to wit: Those who have failed the licensure examination for professional teachers, with a rating of not lower than five percentage points from the passing general average rating, shall be eligible as para-teachers upon issuance by the Board of a two-year special permit, renewable for a non-extendible period of two (2) years. The para-teachers shall be assigned to areas where there is a shortage or absence of a professional teacher, as identified and provided by the Department of Education and the Autonomous Region for Muslim Mindanao (ARMM) education department to the Board for Professional Teachers and to the Commission. The special permit shall indicate the area of assignment of the para-teacher.
WHEREAS, Sec. 3 of R.A. No. 9293 likewise amended Sec. 31, Art. IV of R.A. No. 7836 which now states as follows: Sec. 31. Transitory Provision. - Special permits, with a validity of three (3) and five (5) years, issued to para-teachers by the Board for Professional Teachers before the effectivity of this Act shall be allowed to expire based on the period granted therein: Provided, That only special permits with a validity of three (3) years may be renewed upon expiration for a non-extendible period of two (2) years.
WHEREAS, The Department of Education issued DepEd Order No. 16 s. 2005, mandating every public and private elementary and secondary schools in the country not to employ teachers who are not registered with the PRC, recognizing the need for a Certificate of Registration as an indispensable requirement to practice the profession as mandated by RA No. 7836 (Third Whereas of MOA between DEPED and BPT, PRC).
WHEREAS, through a Memorandum of Agreement, DepEd signified that with the more than sufficient number of registered professional teachers in the country, they will not issue a certification identifying areas where there is a shortage of registered professional teachers (Fourth Whereas of the afore-said MOA).
NOW, THEREFORE, by virtue of its quasi-legislative power under Section 6 (a) of Republic Act No. 7836, the Board RESOLVES, as it is hereby RESOLVED, to adopt, issue, and promulgate the guidelines on the issuance of a special or temporary permit to para-teachers:
I. Issuance of Special Permits to Para-teachers under Sec. 26, Art. IV of R.A. No. 7836 as amended by Sec. 2 of R.A. No. 9293:
1) Pursuant to the MOA between the BPT, PRC and DepEd, BPT/PRC shall not accept applications for issuance of temporary/special permit to para-teachers unless DepEd provides a list indicating shortage or absence of professional teachers in the areas within their jurisdiction.
2) Special Permits for Para-Teachers may, however, be issued for the Autonomous Region of Muslim Mindanao (ARMM) on the basis of the following:
a) ARMM shall provide a list identifying the areas where there is shortage or absence of professional teachers which shall be officially communicated to the Board and the Commission through a Memorandum Circular;
b) The list shall be the basis of the Board and the Commission to accept applications for issuance of temporary/special permits to Para-Teachers and issue the said Permits upon approval thereof through a Board Resolution;
c) The Office for the Professional Teachers shall require the payment of Two Hundred pesos (P200.00) per year from the applicant upon application or Four Hundred pesos (P400.00) for the two-year validity period of the special permit. Should the applicant decide to renew the special permit for another two years, the applicant shall be required to pay the amount of Four Hundred pesos (P400.00) upon application for renewal to be counted from the expiration date of the initial special permit.
II. Special/Temporary Permits issued to Para-teachers pursuant to Sec. 26, Art. IV of R.A. No. 7836 prior to the effectivity of R.A. No. 9293
A) Special/Temporary Permits with a validity of three (3) years
1) Special/Temporary permits for Para-teachers issued by the Board and the Commission prior to the effectivity of R.A. No. 9293 shall be valid within the period specified therein;
2) Special/Temporary Permits for Para-Teachers under this validity period may be renewed for a non-extendible period of two (2) years;
3) The renewal and validity date shall be counted from the date appearing on the Board Resolution approving the application for issuance of Special/ Temporary Permit to para-teacher, disregarding the date of payment of fees for the issuance of Special/Temporary Permit.
B) Special/Temporary Permits with a validity of five (5) years
1) Special/Temporary Permits for Para-Teachers with a validity of five (5) years shall be valid within the period specified therein;
2) Special/Temporary Permits issued under this validity period may no longer be renewed pursuant to R.A. No. 9293.
FURTHER, RESOLVED, the herein Resolution shall take effect after fifteen (15) days following its full and complete publication in the Official gazette or any newspaper of general circulation in the Philippines.
FINALLY, RESOLVED, to circularize and disseminate widely the herein Resolution through the Department of Education and the Autonomous Region of Muslim Mindanao
