[ ERC RESOLUTION NO. 22, S. 2010, September 27, 2010 ]
A RESOLUTION ADOPTING THE RULES GOVERNING THE TYPE APPROVAL OF METER PRODUCTS TO BE USED IN REVENUE METERING BY DISTRIBUTION UTILITIES AND REDISTRIBUTORS
WHEREAS, Section 2 of Commonwealth Act No. 349 (CA 349) authorizes the ERC to inspect, examine and approve periodically all meters used by all public services to ensure their accuracy;
WHEREAS, Section 43 (t) of Republic Act No. 9136 (RA 9136) empowers the ERC to perform such other regulatory functions as are appropriate and necessary in order to ensure the successful restructuring and modernization of the electric power industry;
WHEREAS, the ERC formulated a set of Rules Governing the Type Approval of Meter Products to be Used in Revenue Metering by Distribution Utilities (DUs) and Redistributors;
WHEREAS, the said Rules aim to protect the public interest by ensuring that watt-hour meter products installed by DUs or Redistributors conform to standards and requirements adopted by the ERC in order to guarantee the proper functioning of said meters under normal working conditions;
WHEREAS, the said Rules also establish a common database of acceptable types of watt-hour meters for reference of all DUs and Redistributors in procuring watt-hour meters for their customers use;
WHEREAS, the said Rules were posted on the ERC website and published in a newspaper of general circulation;
WHEREAS, expository presentations and public consultations were conducted thereon to solicit comments from interested stakeholders;
WHEREAS, the revised draft Rules incorporating the comments of the stakeholders were posted on the ERC website on July 12, 2010;
NOW, THEREFORE, after careful deliberation on the issues relative thereto, the ERC RESOLVED, as it hereby RESOLVES, to APPROVE and ADOPT the Rules Governing the Type Approval of Meter Products to be used in Revenue Metering by Distribution Utilities and Redistributors , hereto attached as Annex A * and made an integral part of this Resolution.
All rules and guidelines or portions thereof issued by the ERC not consistent with these Rules are hereby repealed or modified accordingly.
This Resolution shall take effect fifteen (15) days following its publication in a newspaper of general circulation.
Let copies of this Resolution be furnished the University of the Philippines Law Center - Office of the National Administrative Register (UPLC-ONAR) and all entities engaged in the electricity metering.
