[ PRESIDENTIAL DECREE NO. 1970, February 14, 1985 ]
AMENDING PRESIDENTIAL DECREE NO. 1079 BY REQUIRING ALL NEWSPAPERS OR PERIODICALS TO STANDARDIZE THEIR RATES OF PUBLICATION OF NOTICES AND ANNOUNCEMENTS AND LIMITING THE DISTRIBUTION, BY RAFFLE, OF JUDICIAL NOTICES AND ANNOUNCEMENTS BY THE COURTS TO NEWSPAPERS OR PERIODICALS WITH STANDARDIZED RATES OF PUBLICATION.
WHEREAS, newspapers or periodicals do not have uniform rates of publication and are actually charging different rates, thereby resulting in unnecessary delays and squabbles among interested parties;
WHEREAS, these delays affect the normal and early disposition of cases requiring publication because the big difference of rates being charged by some publishers makes the implementation of the result of the raffle difficult; and
WHEREAS, for the aforementioned reasons, there is a need to standardize the rates of all newspapers or periodicals of notices arising from court litigations, and to limit the distribution thereof by raffle to newspapers or periodicals charging the standardized rates of publication.
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree:
SECTION 1. Section 3 Presidential Decree No. 1079 is hereby amended to read as follows:
“SEC. 3. No newspaper or periodical shall charge for the publication of the said notices and announcements less than ten pesos (?10.00) per column inch, nor more than eighty percent (80%) of their regular commercial display advertising rates: Provided, That publications whose regular commercial advertising rates are lower than ten pesos (?10.00) shall not charge below ten pesos (?10.00) per column inch for the publication of the above mentioned notices and announcements: Provided, further, That in case of publications that do not carry commercial display advertising, the rate for the publication of legal and judicial notices shall be fixed at ten pesos (?10.00) per column inch: Provided, furthermore, That newspapers or periodicals may only charge more than ten pesos (?10.00) up to eighty percent (80%) of their regular commercial display advertising rates when there is proper and adequate proof that the rate claimed is the regular commercial display advertising rate: Provided, finally, That all newspapers or periodicals shall be required to standardize their rates of publication of notices and announcements, and that the distribution by raffle of judicial notices and announcements shall be limited to newspapers charging the standardized rates of publication.”
SEC. 2. Effectivity. — This Decree shall take effect immediately upon approval.
