[ MEMORANDUM ORDER NO. 82, May 27, 2015 ]
AMENDMENT OF VARIOUS ORDERS IN VIEW OF THE APPOINTMENT OF ATTY. MENARDO I. GUEVARRA AS DEPUTY EXECUTIVE SECRETARY FOR LEGAL AFFAIRS (DESLA)
WHEREAS, on 04 May 2015, Atty. Menardo I. Guevarra was appointed as DESLA vice Michael G. Aguinaldo;
WHEREAS, there is a need for a formal transfer of the specific grant of authorities, functions, and committee memberships from former DESLA Aguinaldo to DESLA Menardo I. Guevarra; and
WHEREAS, Section 27, Chapter 9, Title III, Book III of Executive Order No. 292, otherwise known as the Administrative Code of 1987?, empowers the Executive Secretary to exercise supervision and control over the various units in the OP Proper, including their internal administrative requirements, and to determine and assign various matters to the appropriate units in the OP;
NOW, THEREFORE, I, PAQUITO N. OCHOA, JR., by the powers vested in me by law, do hereby order the following:
SECTION 1. TRANSFER OF SPECIFIC AUTHORITIES, FUNCTIONS, AND COMMITTEE MEMBERSHIPS.
1.1 All MOs, SOs, OOs, memoranda, letters of instruction, and other orders issued by the Executive Secretary granting then DESLA Aguinaldo authority to decide, approve and/or sign various papers or matters in the OP, including, but not limited to: MO No. 77 s. 2015, MO No. 47 s. 2012, and Memorandum from the Executive Secretary dated 01 July 2011; SO No. 302 s. 2014; SO No. 218 s. 2014 and SO No 137 s. 2014; SO No. 56 s. 2014 and SO No. 254 s. 2011; Memorandum from the Executive Secretary dated 14 July 2011 for Secretary of Finance Cesar V. Purisima and Letter dated 29 June 2011 to the Country Director of the World Bank; and Letter dated 29 June 2011 to Land Bank Malacanang Extension Branch Head Marissa A. Garduque, are hereby amended so as to grant incumbent DESLA Menardo I. Guevarra the authority to decide, approve and/or act on the matters stated in the aforesaid issuances;
1.2 All MOs, SOs, OOs, memoranda, letters of instructions, and other orders issued by the Executive Secretary designating then DESLA Aguinaldo to various committees and bodies within and outside the OP, including, but not limited to: SO No. 514 s. 2014; SO No. 141 s. 2014; SO No. 513 s. 2012, SO No. 93 s. 2012 and SO No. 603 s. 2011; SO No. 188 s. 2012; SO No. 414 s. 2011; SO No. 309 s. 2011; OO No. 35 s. 2015; Memorandum from the ES dated 28 October 2011; and Letter to Secretary of Justice Leila M. De Lima dated 29 July 2011, are hereby amended so as to transfer to incumbent DESLA Menardo I. Guevarra the authority to represent the Executive Secretary, and to be a member of the committees, teams, and technical working groups specified in the aforesaid issuances;
1.3 All MOs, SOs, OOs, memoranda, letters of instructions, and other orders issued by the Executive Secretary assigning additional functions to then DESLA Aguinaldo as part of the operational arrangements in the Office of the Executive Secretary including, but not limited to OO No. 23 s. 2012, are hereby amended so as to transfer to incumbent DESLA Menardo I. Guevarra the functions specified in the said issuances; and
1.4 All other MOs, SOs, OOs, memoranda, letters of instructions, and other orders granting authorities and assigning certain functions specifically to former DESLA Aguinaldo, are also amended so as to transfer to incumbent DESLA Menardo I. Guevarra the authorities and functions specified in the said issuances.
SECTION 2. POWER OF THE EXECUTIVE SECRETARY
It is understood that the transfer of authorities and functions in this Order from former DESLA Aguinaldo to incumbent DESLA Guevarra does not preclude the Executive Secretary from directly performing the same authorities and functions at his discretion.
SECTION 3. BONDS AND OTHER ADMINISTRATIVE REQUIREMENTS
It is understood that all administrative requirements for the discharge of the authorities and functions transferred herein, including the posting of a bond whenever prescribed by applicable rules and regulations, shall be complied with.
SECTION 4. REPEALING CLAUSE
All MOs, SOs, OOs, circulars, memoranda, letters, and other issuances, or parts thereof, which are inconsistent with the provisions of this Memorandum Order are hereby repealed or modified accordingly.
SECTION 5. EFFECTIVITY
This Memorandum Order shall take effect immediately.
