AN ORDINANCE CONTROLLING DOG POPULATION THROUGH CASTRATION WITHIN THE TERRITORIAL JURISDICTION OF QUEZON CITY.

WHEREAS, Section 458 (4) (viii) of Republic Act No. 7160, otherwise known as the "Local Government Code of 1991", empowers the Sangguniang Panlungsod to enact ordinances that shall regulate activities "xxx within the city in order to promote the general welfare and for the said purpose shall provide for the impounding of stray animals, regulate the keeping, of animals in home or as part of business, and the slaughter sale or disposition of the same and adopt measures to prevent rind penalize cruelty to animal";
WHEREAS, Republic Act No. 9482, also known as "Anti-Rabies Act of 2007", aims to promote responsible dog ownership to control and minimize the incidents of animal rabies in the community;
WHEREAS, Section 10 of the aforementioned law, provides that 'In furtherance of the policy of this Act to eradicate Rabies, there is the need to control the Dog population and minimize the number of unwanted stray dogs, as such. It la hereby mandated
WHEREAS, castration is the process in which dog can be spayed or neutered. Spay refers to the removal of female animal's ovaries and uterus while the tern neuter refers to the removal of male animal's testicle so that they cannot reproduce;(1) That the DA, DOH, DILG, DepEd, LGUs, with the assistance of NGOs and POs shall undertake an educational and promotional campaign on responsible Pet Ownership, including the option of spaying or neutering their Dogs;(2) That the LGUs shall provide an incentive system whereby Owners of Dogs which have been spayed or neutered will be given a subsidized or discounted pet registration fee;(3) That Dogs which have been Impounded three times shall only be released after having been spayed or neutered, at the expense of the Pet's Owner."
WHEREAS, studies show that castrated dogs have advantages, such as but not limited to prevention of roaming due to detection of "In heat" of female dogs, reduction of instances of excessive barking, mounting, aggression, improvement of the health of dogs, and a means to check over population:
WHEREAS, this Ordinance alma to control dog population in the city by promoting responsible dog ownership through Quezon City's dog spaying/neutering program.
BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON CITY IN REGULAR SESSION ASSEMBLED:
SECTION 1. TITLE - This Ordinance shall be known as the "Quezon City Dog Castration Ordinance".
SECTION 2. SCOPE - the Quezon City Health Department Veterinary Services Department (QCHDVSD) shall castrate dogs under the following instances:
SECTION 3. IMPLEMENTING AGENCY - the QCHDVSD shall be in charge in the implementation of this Ordinance.
- Complaint involving incident/s of dog bite in the Barangay. provided a written notification was given to (he dog owner,
- Dogs which have been Impounded for three limes shall only be released after having been spayed or neutered, as mandated by RA No. 9482;
- Dogs which are spayed/neutered as requested by the dog owner;
- Dogs without adequate, clean and sanitary facilities.
SECTION 4. PROMOTION AND AWARENESS PROGRAM - In order to promote responsible ownership by way of controlling dog population, the QCHDVSD is mandated to conduct city wide awareness campaign and castration programs.
SECTION 5. INCENTIVES - Dog owners who castrated their dogs by the QCHDVSD shall enjoy a twenty percent (20%) discount for pet registration fees.
SECTION 6. APPROPRIATION - The amount necessary to implement this ordinance shall be taken from the annual budget of the QCHDVSD for the year 2016. Thereafter, an annual budget shall be allocated for its continuous operation.
SECTION 7. IMPLEMENTING RULES AND REGULATIONS (IRR) - The QCHDVSD shall draft the IRR for proper operation of the ordinance within 30 days after its effectivity.
SECTION 8. SEPARABILITY CLAUSE - If for any reason, any part, section or provision of this Ordinance shall be held invalid or unconstitutional, other provisions or parts thereof not affected thereby shall remain in full force and effect.
SECTION 9. REPEALING CLAUSE - All other Ordinances, Executive Orders, Rules and Regulations or parts thereof which are inconsistent with this Ordinance are hereby repeated or modified accordingly.
SECTION 10. EFFECTIVITY CLAUSE - This Ordinance shall take effect fifteen (15) days/after its publication in a newspaper of general circulation.
