AN ORDINANCE REQUIRING DEALERS/RETAILERS OF LIQUEFIED PETROLEUM GAS (LPG) TO HAVE A WEIGHING MACHINE DURING "DELIVERY, PROVIDING PENALTIES FOR VIOLATION THEREOF, AND FOR OTHERS PURPOSES.

WHEREAS, it is the avowed policy of the Quezon City Government to protect and promote consumer welfare through policies that would deter unscrupulous traders from short-changing their customers;
WHEREAS, it is the right of every consumer to demand for an accurate weighing, method of the consumable goods that he is buying. This is so because the price one has to pay will depend on the weight of the said article;
WHEREAS, for those who are using or buying gasoline or diesel for the use of their vehicles, the quantity of the product that they buy is measured by the gasoline pump, the calibration of which is regulated by the Energy Regulatory Board (ERB). However, products like LPG which is sold to the public in various containers of different sizes, is not similarly regulated.
WHEREAS, the consumer of LPG has no way of determining whether the content in the LPG tank that he has received from the dealer has the correct weight, and in most cases the buying public has to rely on the honesty and goodwill of the distributor or dealer. This is so because a number LPG dealers or distributors do not have any weighing scale during delivery.
WHEREAS, under these circumstances, there is a clear need for a regulatory Ordinance that will require every, dealer or distributor of LPGs to have an available weighing scale or machine during delivery to give assurance to every consumer that he is getting an LPG of proper weight as advertised or as stated in the outer portion of the tank.
BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON CITY IN REGULAR SESSION ASSEMBLED:
SECTION 1. Every retailer of Liquefied Petroleum Gas (LPG) is required to have a weighing scale or weighing machine duly sealed by the City Treasurer's Office during delivery in order to give the buying public an opportunity to check the correctness of the weight of every LPG tank that they are buying;
SECTION 2. In order to complete the delivery, the delivery person, being the duly authorized representative of the seller/LPG store / establishment, shall weigh the tank in front of the customer/ consumer. In the event that the weight is lesser than what appears to be indicated in the LPG tank, the price shall be correspondingly reduced or the cylinder shall be replaced by the seller with another cylinder of proper weight.
SECTION 3. PENALTY CLAUSE. Any person who shall be found guilty of violating any of the provisions of Section 1 and 2 of this Ordinance shall pay a fine of One Thousand Pesos (P1,000.00) for the First Offense, Three Thousand Pesos (P3,000.00) for the Second Offense; and Five Thousand Pesos (P5,000.00) for the Third Offense/or revocation of their Business Permit to operate.
SECTION 4. The Business Permit and Licensing Office (BPLO) shall promulgate such rules and regulations as may be necessary to implement the provisions of this Ordinance within thirty (30) days after approval of this Ordinance;
SECTION 5. This Ordinance shall take effect upon its approval.
