[ NAPOLCOM MEMORANDUM CIRCULAR NO. 2013-007, October 30, 2013 ]
AMENDING NAPOLCOM MEMORANDUM CIRCULAR 2000-007 ENTITLED: PRESCRIBING THE SANCTIONS IN CASE OF CHEATING, COLLUSION, MISREPRESENTATION, SUBSTITUTION OR ANY ANOMALOUS ACTS IN CONNECTION WITH THE ADMINISTRATION OF POLICE EXAMINATIONS CONDUCTED BY THE COMMISSION
WHEREAS, in compliance with this mandated task, the Commission conducts examinations twice a year for five (5) categories, namely: PNP Entrance, Police Officer, Senior Police Officer, Police Inspector and Police Superintendent;
WHEREAS, in the previous conduct of examinations, it was observed that there had been instances of cheating, collusion and other anomalous acts which affect the integrity and sanctity of NAPOLCOM examinations;
WHEREAS, to deter examinees from committing any form of cheating during the examinations, stern warnings were indicated on the face of test booklets that their scores will be determined through a computer-generated system, hence, they are forwarned and discouraged to attempt/engage in any form of cheating;
WHEREAS, in spite of these warnings and notices, cheating is still persistently committed by PNP Entrance examinees;
WHEREAS, it has also been noted that there are individuals who use fake NAPOLCOM police eligibility, which is also a form of cheating, in their entry into the PNP;
WHEREAS, the complete disregard of examination rules and regulations is a stark manifestation of dishonesty which is deviant from the vision of the PNP to transform its organization into a highly capable, effective, and credible organization;
WHEREAS, Memorandum Circular No. 2000-007 has insufficient sanctions in cases of cheating and other anomalous acts in connection with the conduct of our examinations;
NOW THEREFORE, the Commission, in the exercise of its administrative control and operational supervision over the PNP and to maintain the integrity of its examinations, DO HEREBY RESOLVE, AS IT IS HEREBY RESOLVED, to amend Memorandum Circular 2000-007 and impose the following sanctions on all cases of cheating and other violations relative to its examinations:

In examination centers where cheating and other anomalous acts are allegedly committed resulting in statistical improbability, the examination results shall be withheld pending investigation and corresponding recommendation thereon; Following are the indicators/conditions of a Statistically Improbable Result:

The examination results of examinees involved in acts of cheating such as, but not limited to the following, shall be invalidated:
The aforesaid examinees shall be permanently barred from taking the NAPOLCOM Examinations. |

In the event that these anomalous acts were committed by a police officer, he/she shall be charged with dishonesty, and if found guilty, be meted the penalty of dismissal from the service; |

Individuals who are found to have used fake NAPOLCOM eligibility for their entry into the police service shall likewise be permanently barred from taking the NAPOLCOM examinations; |
5) |
In the event that it is established that such anomalous practices were committed in collusion with or due to gross negligence of the proctors, examiners, supervisors and other officials and persons assigned, or otherwise involved in the preparation for and conduct of the examinations, they shall likewise be criminally or administratively held liable in accordance with law and the Civil Service Rules and Regulations; |

Police service eligibility obtained through anomalous practices shall be nullified; |
Separability Clause. - In case any provision of this Circular or any portion thereof is declared void by a competent court, other provisions shall not be affected thereby.
Effectivity Clause. - This Circular shall take effect fifteen (15) days from the date of publication in a newspaper of general circulation, and a copy of the same filed with the University of the Philippines Law Center in consonance with the Administrative Code of 1987.
